Hi. My boyfriend posted on the Fiance Visa forum here: http://www.visajourney.com/forums/topic/262034-please-offer-some-advise-k1-w-criminal-history/

So, he went to a bunch of different lawyers and each one of them told him it is HIGHLY unlikely to get beyond the AWA with his criminal history, and also would be very expensive and time consuming. They suggested to us that we take a different route. I am 22 years old, Canadian, and have been planning on moving in with him for the past year or so. The plan was that when I'd get over, I'd start college. SO, that brings us to now. The lawyers suggested that I come to the U.S. on a Student Visa. They also said it'd be the easiest way around this whole mess.

I've been reading up on it, and it's been making me nervous. :/ I was just wondering how the whole acceptance of the Visa works? I have an apartment in Canada, so that shows my ties to my home country, but I am also on social assistance. Will this hurt me? Do they demand to know where you are going to be staying? I have the money for school through my boyfriend, but can you also apply for student loans when you're on a Visa? What are the chances of a denial for this type of visa? As stated in the other thread, the border patrol (at Buffalo) have turned me around twice, is that gonna be a factor?

I spent 3 years in the US on a student visa. You MUST have a US address and you must notify USCIS when you move. So yes, they absolutly must know where you are staying in the US. Further, to be admitted to the school, you must show you have the funds to support yourself. This can be very expensive. When I was accepted, I had to show I had $20,000 to cover tuition, room, and board. And that was for 1 year. The schools will require you to pay out of state tuition, which is very expensive. Yes, you can apply for student loans in Canada but you will not qualify for most student loans while in the US because you will not be a resident.

Your first step is to apply to the school you wish to attend. Begin with contacting the school and speaking to their international student advisor to figure out what you need to do to be accepted.

First you actually need to apply to an university and get accepted.

Then comes the visa part.

you are asking us how to make an intended fraudulent use of a student visa with the intent to AOS.

this is visa fraud, pure and simple.

you are on the wrong site.

this site is geared toward legal immigration.

i suggest you try over at immigrate2us.net, which is full of fraud.

I agree, the OP appears to be requesting advice on how to commit visa fraud - to obtain a student visa with the intent of using it to move to the US then adjust status to be with her boyfriend. Since it is a violation of TOS to continue this discussion I am closing this thread.
