Under Part 1 B of the I-485 form, it asks to list the name of your spouse. I am filling this our for my fiance, so I am the spouse. I have not yet changed my legal name to his last name yet. Should I wait until I change my legal name before sending in the application or should I just list it was my maiden name? (I wont have time to go in to change my name until next week and I want to send out the AOS application asap. I just don't want this to cause any problems in the application. Thanks in advance!

She shouldn't be your fiancée but your wife if you are completing this form.. Assuming you got married and processing your AOS..

If you are sending this application we are assuming you got married, and you have all the documentation required. If you named was not changed during the marriage ceremony and you are planning to change it soon, suggestion will be to process the name change, provide proof and then sent the package..

i think a week waiting is best than a few possible additional months of process and possible money spend..

Yes, technically he is my husband as of a couple of weeks, still getting used to calling him that :) On the marriage certificate I stated that my last name will change and I was told I should change it within 30 days. I was just wondering if I put Elisa "Baral" as stated on the marriage certificate instead of Elisa "Dahlgren-Castilla" (which is stated on my social security card) if that would cause an issue. That is a great suggestion, to put proof of my name change with the application so there are no issues with that. Thanks again!
