hello to all i met a filipina last may and i was wondering if i marrie dher in the phil would i still have to renew a visa every 59 days i heard if u was married to a filipino citizen u dont have to have visa to stay longer than 21 days..i know i could apply for perminent residency but i dont want to do that or else i would Lose my SSI pension i would want to return to the stes once a yr for visits...Godbless to all i hope i get some good advice

I think the visa you're referring to is Balikbayan visa. Yes, it's true that this visa is extended to the Filipino citizen's spouse as well as his/her minor children. A balikbayan can stay up to a year in the Philippines. However, the key requirement is the Filipino is a balikbayan.

Philippine law states that a balikbayan "shall mean a Filipino citizen who has been continuously out of the Philippines for a period of at least one (1) year, a Filipino overseas worker, or former Filipino citizen and his or her family, as this term is defined hereunder, who had been naturalized in a foreign country and comes or returns to the Philippines."

So, if your future Filipino spouse doesn't meet any of these requirements, you are ineligible for Balikbayan privilege. I hope this helps some.

You cannot enter and stay in the Philippines under a Balikbayan visa if you are not Filipino. There are several ways you could stay in the Phils. Are you considering retiring there permanently? Check out the BIA web site for your options. DO NOT OVERSTAY YOUR VISA! It can become expensive if you know what I mean, also you can be blacklisted for entry into the PI for this.

thanks that was some helpful info me and my pinay are not married yet im gonna apply for k1 visa for her using my mother as a joint sponser considering i live in the same house as my mother and her working that shouldnt be a problem but i wanted to check to on philippine visas to have a backup plan incase needed we are in the process of getting my girl a passport as soon as she gets that i will file the I-129F with proof of a ongoing relationship and proof of metting etc thanks for the replies godbless

Keep in mind,,, first,,, the Philippines is not real keen on accepting an Affidavit of Support from someone other then the petitioner

in the case of a K1 visa. And, second, if you get a K1 visa, she needs to leave the Philippines and reside in the USA for the better

part of 3 years.

I flew into Hong Kong a year ago met my wife there then flew to Manila and recieved a balikbayan visa, the laws say the filipino has to be out of the country for an amount of time but the customs people just don't care even if its one day, have done it myself and know many others that have too, alot of expats do the annual visa run to Macau do a little gambling then return the next day with thier spouse and recieve another balikbayan visa good for a year

Why would you loose you SSI Pension???

OK a couple of things Stoney, first, SSI is not a pension, it is a means tested public support, I hope you are on maybe SSDI or regular social security (and with those later incomes you can recieve anywhere in the world except cuba or vietnam) or you just may have issues with being able to prove you will be able to support your wife, two you are also going to need to show you have phisically met your fiance' in person within the last two years ie. plane tickets, photos, etc. along with proof of a bonified relationship I think IMO the consul will definetly question a two month relationship and marriage proposal just my honest opinion ...

I stand corrected. As of 11/2007 foreign spouses are elegible to enter under their Filipino spouses balikbayan visa.

if he gets married he can apply for a 13a visa in the philippines and for sure he would be approved
