CR1 Visa Review. What the heck is it?

Ok, i am somewhat in a similar situation.Yesterday i called the us embassy in Romania to find out if my casefile arrived here from NVC. The lady on the phone said ''yes, we have just received it yesterday'', then i asked her what can she tell me about it, if it's complete and if there is anything else i need to send them.She looked in hurry over the papers , and she told me ''there is a problem with your affidavit of support'' i see only 14k made in 2009 by your husband.Talk to him and either send us in a bank statement with 15k in it or get a joint sponsor. I was like !!!!???? so i talked to my hubby, long story in short version is that in 2009 he was in Romania, he then left to US and got a job in April 2009,so thats why the 14k only.But he also sent in a copy of his work contract, his income since January 2010 that clearly shows that he makes much more in one year than the minimum they require.He emailed them explanation, and hoping he will get an answer soon.So you think this is just a misunderstanding, isn't it enough that they see what he makes in one year total and is more than enough? Why would NVC accept all our docs and sent us no rfe's at all if there were issues like this; lucky me that i called embassy here and she was nice enough to explain all this things BEFORE my interview which will be on the 15th of July...

Looks like you are pretty much in the same situation as we are except you got time to fix it :star: I made about that much last year since I was in Turkey for a good 5 months or so. So I didn't make enough. I did send my wife employment letter, pay stubs and 2009 tax year. I didn't think I would have to send bank statement since I am making over the poverty line with my new job. We didn't get an RFE or anything through the whole NVC stage for whatever reason just like you. Just make sure to get a bank statement or a bank letter from your husband showing that you have 15k or more in bank account otherwise you will be in the same situation as us. Do it asap before your interview that way you get approved and don't get stuck!! Goodluck to you and your husband :star:

This is what i was afraid of ! So practically hubby earned more than 20k in the period of April 2009- April 2010, and it doesn't matter, because it was not made since Jan 2009-Dec 2009 ???? I mean this is what they care about? The way we count years and they do not care that he can show he can support me with his income made in one year total? Basically it sounds like they are telling us ''oh bummer you should have been in US and started your job in January not in April '' ? My hubby still can not believe this and he is waiting for a positive answer from them.

I think they care about how much is in your husband's bank account because they want to see he has enough money to support you just incase he loses his job. That is why they want to see bank statement or letter. His income might be enough to support you, but they want to see the same in bank account. That is what most people are telling me. So as long as your husband got 15k or more in his bank account, you will be fine. He just needs to go to his bank and get a bank statement to show 15k or more in funds. Atleast you have some knowledge prior to your interview unlike us.

Thank you for all your help, i know what you mean when you say at least we know now, and i did not get delayed at the interview because of this.Still, this is not a way they can treat people. The lady on the phone also told me either to get a 15k bank letter or a joint sponsor.My hubby's brother can help us with no problem, i am just wondering if i have this option now after my case is at the Embassy here ?

It doesn't have to be $15,000. That is the specific amount that Rani and Raja needed to meet the poverty level requiremnts. Since he didn't make enough, they had to come up with that amount. Sachi explained in an earleir post in this thread. Would look for it, but am at work, and have to log out for a bit.

Yes, you should still have that option at the interview, to present a joint sponsor.

It is entirely possible that the CO made a mistake. While they DO look over your whole financial picture, as you said, she was in a hurry and may not have even seen the latest employment information - or, she doesn't understand the guidelines (it happens).

Hopefully your Husband will get a positive response to his email.

Thank you everyone for your help in this.I also read Sachi's post ,i understand what she is saying.Yes, my hubby is mainly concerned about that lady who probably was a CO, he wants to make sure they reviewed all our papers.Still, if this is the case, i am not sure he can come up with 15k in such a short period of time.His brother is willing to help us at any moment, i am just worried cause that would mean i get the joint sponsor papers directly to the interview and NVC did not have a chance to see them; unless the CO here has the last saying in this anyway.

The I-864 is evaluated on interview day by the CO. S/He has the final say, no matter what NVC did or didn't do. If your 2009 taxes aren't looking so hot, get a bank statement with the required level of funds in it or get a joint sponsor.

My husband had a new job that was putting him well above the poverty guidelines after we went through NVC but prior to interview day. It was implied that that job was 'too recent' and the joint sponsor was kept on record.

You can produce the joint sponsor's papers directly at the consulate.

My original joint sponsor (who we used during the NVC process) changed his mind and refused to send me any paperwork for the interview (I needed his 2009 taxes) so my FIL stepped in as the joint sponsor and I produced his taxes and I-864A at the interview. We had no issues though I don't know who the joint sponsor currently on record is.

Looks like your best bet is to have a joint sponsor papers ready for the interview so everything goes smoothly! So you got some time to fix it. I never sent bank statement because I thought if you make above the poverty line than its fine. CO has the final say to everything, but the one my wife had at the interview didn't let us slide :hehe:

'Dear Mr. B.

Thank you for sending us the most recent pay stub.

It appears from it that your annual income is sufficient to sponsor your wife. The consular officer will review the documents at the time of the interview.'

I have to mention to you that, my husband not only did he sent them an email asking about what they told me over the phone, also he attached in that email all the affidavit of support documents. So what do you think i should do? Should i just disregard what she said that day, or have a joint sponsor paper ready for the interview, just in case ?

'Dear Mr. B.

Thank you for sending us the most recent pay stub.

It appears from it that your annual income is sufficient to sponsor your wife. The consular officer will review the documents at the time of the interview.'

I have to mention to you that, my husband not only did he sent them an email asking about what they told me over the phone, also he attached in that email all the affidavit of support documents. So what do you think i should do? Should i just disregard what she said that day, or have a joint sponsor paper ready for the interview, just in case ?

Hello Raluca,

I would get a letter or statement from the bank stating 15 K or how much embassy was told on the phone .If its easier for you then get a joint sponsor. Just be ready for anything. So you could summit right away whatever they want. And you will not have to wait.

As my wife said, prepare for anything and everything. Have joint sponsor ready for the interview just incase the CO says the income is not sufficient or something. As most people have said, the CO has the final say. You got the information prior to your interview so prepare everything!! Just learn from our mistake so you don't make it. That way you can be approved the same day and get visa in few days. Goodluck :star:
