We just submitted our K-1 fiancée petition earlier this month and received our NOA1 so we are in the “hurry up and wait game”.

I want to be proactive with some of the various future documents that we need to start gathering so here is my question:

My Colombian fiancée has a young son. She was never married. The biological father lives in Europe and has had very little to no communication with his biological son. The biological father provides no financial support and no emotional bonds exist. There is no documentation as to custody issues whatsoever (like we typically have here in the states). The son's last name carries the biological fathers name.

What, if any, permission is needed from the biological father when it comes time for my fiancée and her son to leave the country? Will we need to track the biological father down in Europe and get him to sign for his permission that the child can travel out of the country with the mother?

Thanks in advance if you have any experience with this situation.

every time the child travels to Colombia will need a permit to leave Colombia and it must be recent, as the father is absent, she may seek advice with ICBF (Instituto Colombiano de bienestar familiar, an edict must be published for 1 month in a newspaper and the ICBF will give you the permission) so she can get a special permission, is better start now to get full custody, if it is possible.

Another option your fiancée has is to contact the DAS to find out exactly what she may need, the DAS is the one who needs to see the permission slip in order to let the child leave the country. If the father lived in Colombia he would need to go to a notary to sign a notarized permission slip. Even though he's out of the country and doesn't have much contact with his son, she still needs to get this permission from him, but I think the DAS would be the right place to find out what needs to be done. I'm thinking she would need a notarized, apostilled and translated (if needed) permission from the father to start with.

Please let us know what she ends up needing as it may be beneficial to other members.

Thank you all for your response. She did visit DAS last week in Bogota and basically the procedure that Diana mentioned above is correct, must have fathers written permission. We will update this thread as the process becomes more well defined. Thanks again.

U can see if there is a colombian embassy where he is located as they will have the forms there and may make it easier. It can not be older than 60 days ( we had 2 that traveled often and now just one ). Is the father willing? If so this shoulod be easy but check on the date because it must always be recent until the child turns 18 as the child is a colmbian citizen :)

Why is it that the only one who can stop the crying is the one who started it in the first place?
