Hi everyone!:blush:

I have been hearing about AOS (adjustment of status)which means a procedure that allows an eligible applicant to become LPR of the US w/o having to go abroad and apply for an immigrant visa.

I understand immediate relatives of USC dont have to spend time waiting for their priority dates.

Here's my case, My mom was granted multiple entry US visa and would come to visit me here in the US once in a while.Her visa is good for 10 years.She hasnt overstayed and no unlawful record whatsoever.I am planning to petition her using I130 s0on but my questions are, if her petition is approved while she's here in the US,is she eligible to apply for AOS???Is it favorable to her in terms of shorter wait period to be with me?and is it favorable to me in terms of fees?Should i submit my I-130 petition while she's in the Philippines or should i submit it while she's here?Any insight will be appreciated.Thank you in advance. :help:

04-16-11:USCIS lost our I485 forms thus received EAD rejection notice

04-18-11: mailed AOS packet AGAIN

04-19-11:AOS packet received by S. Bush

04-29-11: NOA1 hardcopies for I485 and I765 received :)

05-12-11:Successful walk in biometrics

05-25-11:email notification received stating interview on 6/24

05-27-11:hardcopy for interview received

06-24-11:done with interview.no approval yet

06-25-11: received EAD card

06-29-11:email received AOS approved and green card is on its way! yay! :)

My understanding is that you are not a citizen at this point. Is that correct? If so, you are not eligible to petition her at this point. You may do it when you are a citizen.

In terms of the I-130, are you asking whether the processing time is faster when adjusting her status in the US vs. if she is overseas? It's faster in the US.

Oops, I'm sorry. I missed the title :blush: You could petition for your mom. I've read on here that there may be problems for people who adjust from non-immigrant visas to immigrant visas in the US. Something about misusing the visa, although it seems that AOS for spouses of citizens tends to go smoothly. It might be the same for parents of US citizens.

In terms of processing times, I petitioned for my mom and it took 4 months to get the approval notice. The adjudicator made a mistake and wrote on the notice that my mom was eligible for AOS. The thing was that she has never visited the US. But they did approve it and it took 4 months for it. Good luck!

My understanding is that you are not a citizen at this point. Is that correct? If so, you are not eligible to petition her at this point. You may do it when you are a citizen.

In terms of the I-130, are you asking whether the processing time is faster when adjusting her status in the US vs. if she is overseas? It's faster in the US.

Thanks for replying! I am now an american citizen.Im just not doing it at this point coz i just filed petition for my fiance last month.:)

So is it possible to just do AOS once her petition is approved and she happens to be in the US?:blush:

Thanks for replying! I am now an american citizen.Im just not doing it at this point coz i just filed petition for my fiance last month.:)

So is it possible to just do AOS once her petition is approved and she happens to be in the US?:blush:

I;m sorry, I dont want to give you any incorrect information. My understanding is that you would have had to write on the petition that she was in the US at the time that you submitted it. If not, that she will need to go through the immigration process overseas. I will double-check this with someone and then I will get back to you. Or maybe others will reply :)

just thinking aloud..

You have to be a citizen first before you can apply petition for your mom.

If she has no problem in waiting back home, i would rather do the immigration thing to avoid the hassle in waiting for AOS application process. remember that its so hard to go back and forth to any of the offices you needed to go like fingerprinting, medical not to mention the fees....thats exactly what i did for my mom, it took only five months including the interview for her to become a 10 year green card holder..no hassle on my side.....if i remembered i only spent $400 for the visa fee, $70 for the affidavit of support,$257 for medical back home and the flight ticket. 8 days after arrival here she got 10 year green card and 10 days after her ss card directly from the mail...so dealing with all those offices is a big hassle from my end beacause of my work. the hassle and documents needed just to be granted with all those documents is a big pain not to mention the waiting game....

p.s. AOS adjustment will cost you $1,010.00

$350 Full medical and vaccination, i think it varys from Dr.s offices.

AOS needed a lot of documents, the waitings, hassle for fingerprinting and all that.

SS card, hassle of gathering documents and hassle of going to the office .
