I-693 and Adjustment of status.

I am adjusting my status in the US and had my medical examination at the local CS .The CS gave me Tetanus shot and asked me to go to the public health department.When i went there the nurse gave me MMR shot and asked me if i needed Varicella .Now since i am stupid and don't understand english i confused Blood drawn from my forearm with the Varicella vaccination and told nurse not to give me Varicella Shot . When i went today to get my form I-693 back from the CS the nurse there asked me to get Varicella so again i went to the same public health department and now the nurse says that i would have to wait for 28 days which is a long time especially when i am about to be out of status.I called the CS and she said she could mention that i would not be able to get Varicella before July 14 on the form I693 and i can get it next month but my concern is in that case i would be issued an RFE and that would delay my Adjustment of status . My points of concern are :

]1)Should i wait for 28 days and then start my AOS ?

2) Should i send just form I-130 and send I-485 later after getting the Varicella shot next month with the receipt of I-130 .so i wont be out of status and wont have to pay extra $ 300 for the I-751 ?

3) Send the form I-693 with I-130 and I -485 with CS mentioning that i wont be able to get Varicella for 28 days and get my Varicella next month and send the evidence of that in July ?

4) What could be the best possible solution ?

Guys please help .I am in trouble.Any suggestions are highly appreciated .Thanks in advance.

I would go with your third option, in the meantime they will start processing your AOS, they will issue a NOA1 which will prevent any possible problems, and they will probably then issue a RFE. At that point though, you will be close, if not done, to the Varicella shot, and you will be able to reply to the RFE immediately and processing on your case will be resumed.

Make sure you include the complete report from the surgeon with an explanation as to why you have to wait for the shot. Basically you should have gotten MMR and Varicella at the same time, otherwise once you get a vaccine you have to wait 1 month to get another one. It's either all at once or one every 30 days or so. But you can fix this, so no worries!

It happened to me with the measles, US wants 2 shots, Italy only 1. Thankfully when I went in for the medical for the K1 and they told me I needed the 2nd shot as per US Law, it had been 2 months since my last shot which was for Tetanus I think, so I was ok to get another one.

Thanks a lot for the quick reply.I think i will start my adjustment of status with the CS mentioning that i can't get Varicella shot for a month.In case i get an RFE for not getting Varicella shot right now what i am supposed to do ?

Go back to the same CS, get Varicella shot ,get it transcribed by the CS on the I-693 and send the whole thing back in the sealed envelope or i would have to get the whole medical examination again and pay $300 one more time ? Guys please help as i am in deep trouble.Thanks in advance......

It seems like you are not adjusting from a K1 and did the medical here in the US, is this correct?

If this is what I think, then all you have to do is wait for the RFE (I doubt it will come before 3 weeks after submitting), in the meantime as soon as the 28 days or whatever they say are up, get the shot and have the CS fill out the i-693 form saying that all vaccination are now complete. Also, I would try to get the shot in a private clinic, if you think the CS will charge you a lot for that. I woould include the receipt of the payment for the shot as well, just to be on the safe side.

Keep in mind that in SOME cases, USCIS doesn't even send an RFE and can decide to wait until the interview (if you get one) for example. If you don't get an RFE, make sure you still get the shot, as tehy can surprise you and send you one at any point until you get your green card.

If you have proof that you've had it(hospital/doctor's visit record), no. Otherwise, yes. I had measles and chicken pox as a child but didn't have proof, so, i was given those shots as well. Ugh!

You can still go ahead and send in your AOS. If for any reason you cannot get the shot, the Cs should fill out the I693 and check the box indicating that it wasn't medically appropriate for you to receive the shot and that you are eligible for a blanket waiver. Can't understand why it's not appropriate, being that you hadn't receive it on the day you did the other shots.

It happens a lot so don't worry about it.

The forum you initially posted in was "AOS from family VISAS". The important fact being, the term "visa". Based on your posts you didn't arrive in the US on a family visa, so you must have arrived on a Student, or Work or Tourist visa, and are now trying to adjust status from that visa to an LPR based on your marriage, so you therefore are AOSing from a "Work, Student or Tourist VISA". In most cases this AOS occurs due to marriage to a USC but it doesn't have to (such as if your work sponsors you for a GC etc).

People like me for instance, arrive on a K1 visa, which is a fiancee visa. It exists for the sole purpose of bringing family together (well actually it's so we can come over, get married and then AOS but you get the idea). There are also K2, K3 and K4 visas that AOS. CR-1 and IR-1 visas are family visas as well (spouse visas specifically) but they are not required to adjust status so they don't go in the prior forum either.
