Hi all well here is my issue my husband had his interview on 6/14/2010 and I was told that in JA they only use ur recent tax returns which was 2009 and I was laided off for most of 2009 so my tax return showed below the poverty level I was confused because I had called the NCV numerous times to see if that would be a problem and they said no because my income now is well over what is required I submitted 6 months paystubs, job letter, 2007,2008,2009 w-2's and tax reurns and my child support award letter. Well no I have to find a joint sponsor I was going to use my dad but now I realized that the house number is the same but he lives upstairs and I live downstairs. I call the NVC they say call the Embassy I called and they say they don't take phone calls, I emailed and got different answers 3 times. Does anyone one know anything about this and also does the joint sponsor have to be family and or live in the same state? Any help is appreciated. thanks

anyone can be a sponsor. friends, family, etc.

a household member sponsor must live in the same residence as you and be a part of the same household. so if you live in the same house i assume that is enough!

read the I-864 A instructions to see if you qualify to use the I-864A sponsor form! if you don't qualify your dad can be a regular joint sponsor.

It does NOT have to be somebody from outside your household. If the sponsor qualifies on their own, have them complete an I-864 and simply explain the living arrangement, so they know it's two separate households at one address.

It does NOT have to be somebody from outside your household. If the sponsor qualifies on their own, have them complete an I-864 and simply explain the living arrangement, so they know it's two separate households at one address.

I emailed the embassy 1st they said no I need a new sponsor, 2nd time they said have my husband make his appointment it's ok, 3rd time they said he needs to bring in the info and the CO will determine if is enough. So I was confused as to what is the right answer.

Two things, I would read up on I-864 very thoroughly and read the poverty guidelines that is stated for your household along with what the joint sponsor income would have to be as well because I think with a joint sponsor he may be included as the household number as well. Email the embassy again to ensure you get an answer that matches. For me I first emailed them to see if they received my fiance's packet they said yes. The second time I emailed them about his packet 3 and they said as soon as they receive his packet from NVC them will send out his packet 3, but I could email them the ds-230 and as soon as they receive his packet them will send him his information. I emailed them again and asked was or was not his case there along with an emailed copy of the DS-230. They said they have his packet and that his interview will be scheduled sometime late july or early august. Emailed them a week later and come to find out his interview was scheduled for the early part of july. Email them again to see and explain the details of all you correspondance with them to get an straight answer from them. They are very inconsistent with their replies. If you can visit the embassy website as well and read up on the I-864 to clarify things for you.

Bajan, it seems like the only answer you are going to get is when you actually go to the embassy. I think you should try to use your father but have your godmother's info as back up. Fill out two different forms and carry them with you. If you present your father's and they say no quickly say, well I have another sponsor and give them her information. It seems like its entirely up to the CO as to what they want, but at least this way you are prepared. Try to put it in writing what you were told all three times you called and present that too.. Awwe Honey, It seems like each Co at the embassies have their own requirements. I did my interview in February and I only furnished them with my husband's 2006 and 2007 tax return ,cause he had not filed any taxes for 2008& 2009 as he was unemployed the end of 08-mid 09, and I was approved on spot. I am assuming they didn't give me hard time with about the taxes cause his salary for the few month he was employed in 09-2010 had exceeded the poverty guideline.

They seem to have such double standard at that place, but based on my understanding from reading the guide on USCIS you shouldn't have a problem using you're dad as a Co sponsor. Good luck and I hope the embassy can confirm this for you, if you're still unsure, please ensure you take a copy of all the e-mail correspondence with them.

A suggestion?

I know that it won't matter to the post office, but where I grew up depending on the configuration of the house, it wasn't uncommon for one residence to have 1234A and the other to have 1234B.

Would that apply in your situation?

Just a thought.

Sorry you're going through this.

The answers you've so far received prove that a lot is left up to the CO's discretion.

I had my interview on June 9 and the CO was not interested in looking at the 07 and 08 tax returns of my fiance. She only wanted to see 09 and she didn't really like what she saw. My fiance earned over 45 000 in 07 and over 50 000 in 08, but just 30 000 in 09 because he got injured on the job and had to cut back some hours until he recovered. She didn't care. She asked us to find ourselves a joint sponsor.

She told me the joint sponsor can literally be anyone, just as long as their income is above the poverty threshold for their household size. So my assumption is that using your father as joint sponsor is more than fine. Many people use their parents to help in this way and many of them share the same home with their parents too so don't worry that you share the same address. Just have him fill out the I-864 and if he's married his wife has to fill out the I-864A.

I agree that you should thoroughly read through the step by step guide for the I-864. It provides very detailed guidance on just about everything you need to know about who should use the form and how.

I'm not an expert so I hope other people can add their input in order to assist you in the best way.

Ok so your godmother, being the main joint sponsor, should fill out the I-864 and her husband -- with whom she filed her taxes -- should fill out the I-864A. This is because the embassy wants to ascertain that one spouse isn't making such a major decision behind the other spouse's back. If one spouse wants to sponsor a friend or relative, then their other half has to be on board with the decision.

To answer your question, yes, your godmother will have to include her husband on the I-864, at point 21C, part 5 and all other dependents she filed on her most recent tax return (2009), point 21E, part 5 (if the godmother has unmarried dependent children under age 21, then they should be entered at 21D, part 5). So let's say she filed one person as her dependent in 2009 her total household size will be 4. That consists of her (your godmother), your godmother's husband, the dependent she filed on her taxes in 2009 and your fiance (who she is jointly sponsoring with you). If she filed for 2 persons as her dependents in 09, then the household size increases to 5 and so on it goes.

Based on her household size, check the 09 poverty guideline to see if she qualifies to be your joint sponsor. Best of luck.

If your godmother has sufficient income/assets to qualify on her own, she can just list those figures and then provide documented proof of it. Such as her own bank account or the figure listed on her individual W2.

Sometimes -- not often -- but it does happen, that the CO will want to see an I-864A from the spouse of the joint sponsor if they file taxes jointly. This is to make sure that the spouse is aware of the commitment being made.

My joint sponsor files taxes jointly with his wife as well but he makes way, way above the guidelines so he just used his income figure. The I-864A from his wife was not required.
