Which one to use K-3 or IR-1/CR-1..?

Hi Vjers,

Here i am again and gathering answers to my Q for my brother-inlaw..Hope u guys can help me..

I'm jst confused bout CR1/K3..which one is best/faster to bring his wife here in US..as i understand K3 is like K1..once she came here she needs to file for aos and she'l have the 2 yr gc while the CR1, once shes here she already have the 10 yr gc..but what are the advantage and disadvantage of this 2 forms..?they're in a hurry to be w/ each other..they jst got married and my brother-inlaw is back here in US while the wify went back to dubai..

The K3 visa - which has virtually been done away with since Feb - ie: if the I-129F and I-130 reach the NVC at the same time they will process the I-130.

But anyway, yes, someone with a K3 will have to adjust status once they arrive and will receive a 2 year greencard.

The only difference with the CR1 is that the person will not have to adjust status, they are immediately a permanent resident. They still get the 2 year greencard if they have been married less than 2 years.

You are confusing the IR1 and the CR1:

CR1 - Conditional Resident - married less than 2 years - receives 2 year greencard - must remove conditions after 2 years and will then receive a 10 year green card.

IR1 - Immediate Relative - Has been married to the petitioner for 2 years or more - receives a 10 year green card.

And the cost of the CR-1 is much cheaper then the K-3. I have seen one member petition for CR-1 completed in only 5 months, and others on K-3 8 months, I feel the benefits of the CR-1 over the K-3 is much better in the long run.

One over the other, may or may not be faster remember it's the totality of your petition that counts, delays and mistakes can add time to any petition.
