how does K3 affect IR-1 Visa?

Can K3 slowdown the I-130 Approval? i just regret sendin it, i want it to be cancelled, n i heard that i-129F and i-130 get accepted at the same time, so that way they would proceed with i-130 at the NVC n it wouldnt get slowed down right? and i dont think it would get slowed down at the USCIS stage, would it? please help! i just regret sendin i-129f hopin that it wouldnt affect my i-130!

they say that it is believed i-130 is put back in line based on the I-129F submission date not the I-130 date. is that true? does anyone know?

I have not seen anyone with proof that they put the I-130 back in line to the I-129f date; by the same token, I have not seen anyone with proof that they don't. It is purely speculation. All in all, you have already submitted both, so the only thing you can do now is sit back and wait for your NOA2s. NVC will close the I-129f when/if they receive it with the I-130. Hang in there, the waiting is hard, but this gives you a chance to make sure you have every single thing you need for the NVC stage.

thank you so much!! i appreciate your response! yes waiting is very hard! and i got almost all my NVC papers ready!and there's no way that the i-129f gets approved before 1-130 n sendt to NVC earlier, right? i hope not!

That you haven't seen the proof of an assertion doesn't prove it's speculation. There's been plenty of evidence. That you haven't seen it, is really more about what you've seen than about what is. Some of us have been watching this very closely for a very long time.

Can you point me to this evidence? There was lots of talk around this while I was doing the CR-1 process, but no one could point to anything that proved it happened. Or didn't happen.

NOA2 is generally the approval date. What happens and has been happening since November of 2006 is that as soon as the I-129F is filed, (unless it's too late to do so) the I-130 and I-129F are joined (put on the same desk or stack) together and processed together. As we have observed the difference between the timelines of I-130 petition filed in a given date range WITHOUT a subsequent I-129F, compared with cases where I-129F petitions were later filed, we have observed over time that adjudication times closely match the I-129F receipt date rather than what one would expect based on the I-130 receipt date. This has been consistent for over three years.

The data or "evidence" is not compiled in any single location, to my knowledge but rather is observed over time. When you've seen b follow a hundreds of times with consistency, it is appropriate to conclude a caused b.

NOA2 is generally the approval date. Your question makes no sense. Both your petitions will be adjudicated together and will wait until they are ready to work cases received on your I-129F NOA1 date, not your I-130 NOA1 date. Right now, expect both cases are together sitting waiting their turn, somewhat later in line than the I-130 would have been if the I-129F had never been filed. When they are both approved together and sent to NVC, NVC will administratively close your I-129F. The net effect is that your I-130 process will have been delayed by the number of days between the two NOA1 dates.

Facts are cheap...knowing how to use them is precious...
