Apply without Birth Certificate?

Any thoughts/ideas on how I can apply for either a K3/K4 or IR1 for my wife/kids without a birth certificate for my son who is 4 days old?

There is no way to expedite the birth registration in Canada (up to 8 weeks) and this must be done before the birth certficate is acquired.

So is there any way to start the process (whether it is K3/K4 or IR1) for them before this point? A letter from the Dr that delievered? Nurses at the hospital? Pictures as proof? Anything?

Don't you get some sort of record of birth at the hospital before you get a birth certificate? Send that paper in and explain how long it takes to get a Canadian birth certificate.

You can file the petition (not apply for anything) and then wait for the RFE for the birth certificate. It should actually be faster that way as petitions tend to be approved within days of responding to an RFE.

Does the child have, as a biological father, a USC ?

Does the USC father meet the 5 year residency requirement ?

IF SO, forget the birth certificate on I-130 petition - instead, get a Consular Record of Birth Abroad, with US Passport, for the Child.
