Hi,

my wife is preparing a written statement explaining why she didn't file for taxes for the years 2008 and 2009 (she was a full time student first and unemployed then). Citing that she didn't meet the requirements as stated by IRS publications 17 and 54 is correct? Is there any other reference to be done?

12/07/2009 - I-130 and supporting documents sent to USCIS office in Rome

12/16/2009 - USCIS office received the form

02/16/2010 - NOA1

02/22/2010 - I-130 Approved

05/27/2010 - DS-230 sent

07/19/2010 - Medical exam in Napoli

07/20/2010 - Interview

07-14-2010 - Interview Date Assigned

07-29-2010 - Medical Exam $750 ETB ($70USD) PASSED

How?! When we called IRS they only told us that the records for 2008/09 were empty. We got her filings for 2007 though. Isn't a statement enough?! The interview is in just 3 weeks!!!!!!!!!!!!!!!!!!!!!!

A short letter from the USC explaining the lack of returns should be enough, with a reason. Here is what my husband wrote- this was accepted no problem:

To Whom It May Concern:

I am Mr Penguin, Penguin's husband and petitioning sponsor. I did not file an income tax return for the years 2005, 2006 or 2007 because I have not worked during my 3 year residence within the Republic of Ireland. Once I came to Ireland, I was unable to find work and so used savings; I was maintained by my wife upon her income and savings. Since I made no income for these years of any type, I was not required to file an income tax return with the Internal Revenue Service.

Sincerely, Mr Penguin.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yeah, my wife wrote something like that as well.

Furthermore, I-864 instructions state:

A copy of your individual Federal income tax return, including W-2s for the most recent tax year, or a statementand/or evidence describing why you were not required to file.
