This newsstory was discussed at work today. Someone said to me - "How is it that these guys got in the country, but your husband still doesn't have his greencard because his background check is not done? Do they not do background checks for student visas especially when the students are from the Middle East?"

Before anybody gets ticked about the 'middle east' comment, remember I'm paraphrasing a question that was put to me.

The fact is that I didn't know the answer. Any takers?

Yes. When these new laws were enacted post 9/11, several of my ME friends from school missed a semester, because it took much longer to renew their visas then before due to increased security checks.

02/23/08 - Filed for removal of conditions.

Sometime in 2008 - Received 10 year GC. Almost done with USCIS for life inshaAllah! Huzzah!

12/07/08 - Adopted the fuzzy feline love of my life, my Squeaky baby th_catcrazy.gif

02/23/09 - Apply for citizenship

06/15/09 - Citizenship interview

07/15/09 - Citizenship ceremony. Alhamdulilah, the US now has another american muslim!

Sept 10 I-129F sent to TSC

2006

Interview - February 13th APPROVED! day 152

April 6 - wedding date day 204

Aug 22 - AOS interview date day 101-total days 342

Sept 29 - green card arrives, done until June 2008 day 140-total days 381

2008

June 30 - I-751 mailed total days 1025

2009

March 9 - Removal of Conditions approved! total days 1277

They both start with the letter M so I'm sure it was a simple mistake. Perhaps the rest are in Mississippi?

My guess is that they saw the trip as a chance to visit friends and family. Two were picked up in New Jersey, which as a very large egyptian population. *shrugs*

What if they were just planning to show up to class 1 week late after seeing/visiting family and friends? What if they simply did not know that missing 1 week of class meant they'd violate their visas?

What if you or your spouse forgot to get married within the 90 days on a K1 visa? What if you didn't know?

Then you marry anyway and apply for adjustment anyway. The out of status time will come up later but if it doesn't exceed 180 days, there will be no ban.

then arrest them when they show up and then deport them and given a life time ban.

MEANING: as far as the gov't is concerned, rules are rules...perhaps I didn't give the best example...but there are tons of what ifs in this world, and excuses shouldn't cut it with the gov't.

Vegas. Legal gambling and oggling topless dancers. I have known many men who would go there specifically for such reasons. Europeans, Africans, S Americans, ME, Far East... hell... working some of the puter cons there in the day... met all types.

I always understood when dealing with immigration that ignorance of the rules was no excuse.

And to go to the effort of getting a student visa, which requires showing a large financial commitment, they must have had a decent idea of the procedure....

Make sure you're wearing clean knickers. You never know when you'll be run over by a bus.

Doubt it, they probably just hired an immigration lawyer to do all the paperwork. I gather they're a dime a dozen.

What I do wonder, though, is whether anyone would be making any fuss at all if eleven white Anglican British students were a week late getting to their university.

The paperwork is not the issue in getting a student visa; showing that you have enough money to support yourself through your term of study, on the other hand, is a HUGE deal.

Regardless of their race, they violated the terms of their visas. However, it would be ignorant to pretend that their race had nothing to do with the search for them, and I don't see that as a problem, personally. Yes, it sucks that you're more closely scrutinised and monitored if you come from the ME, but given the volatility in the region, can't you see why? Imagine the scandal if they'd blown up a building in the middle of the city, having violated the terms of their visa. The first question would be "Why didn't ICE deport them?"

Maybe I'm just harsh.
