Had interveiw without my husband (deployed), they want more evidence! Help!

Hi all,

So I just had to go to our interview on June 15 in DOWNTOWN LOS ANGELES USCIS by myself, since my hubby is still in Afghanistan on his deployment.

I tried to re-schedule - made an infopass appt, explained the situation, but the lady just told me to show up by myself. Which I did, and now I think it was a HUGE mistake!

The interviewer was behaving nicely, but all the time was asking me tricky questions as if trying to catch me on a lie. I have nothing to lie about, but he kept me there for literally 50 minutes. I had a bunch of proof, but he said "Look, I'm not trying to accuse you of any fraud, but we do need to make sure that the marriage is genuine, since marines' salaries double when they marry, which I'm pretty sure you're aware of". I was sooo shocked!

My husband is in the front line right now, I haven't talked to him since April 22nd, and am freaking out, and he has the nerve to say these kind of things??? Sometimes people just blow my mind...

I gave him all kinds of proof (our joint checking, my Tricare insurance through the USMC, lease, pictures, etc). When he looked through my bank statement, and saw only my income deposited, so he inquired where my husband's direct deposit went. I said - he has a separate account that he's had for years with the army, and if I need money, i can go to the bank and withdraw it from that account (which I had to do in April one time).

Now he wants me to print out some paper proving that I have access to that account of my husband. I just tried to log in, and it says "wrong password". And I can't get a hold of my hubby to ask him why I can't log in. I'm given 30 days max to send them the proof, and the faster the better.

They're not even giving me my EAD!!!

He also said that as soon as they get that paperwork, the case would be transferred to their "military unit". What is it? How long do they take?

Has anyone had anything like this happened at the interview when your spouse was not present due to deployment?

Please, help me.

Freaked out.

July 12 Made Info-Pass. They couldn't find my file, then when they did, they told me it had been transferred to the military unit, and they didn't understand why I mailed them my hubby's direct deposit account, so they didn't update anything. They guy at the military unit asked me a few questions, and told me he would make his decision within 2 days.

Well if they feel that any marriage that a Marine enters into has an incentive for fraud due to doubling of the salaries, the entire US Marine Corps should have all of their marriages investigated, even if the soldiers are married to US citizens. That is the responsibility of the DOD.

The responsibility of the DHS is to ensure that the marriage was not for the greencard.

If you have access to his account, you should be able to go / call the bank and ask for something from them in writting.

I would;

1. Call the banks customer service center and inquire. If the customer service cannot help;

2. Go to a local branch, bring ALOT of ID (ie; state id, marriage certificate etc)

3. Speak to a banking manager and explain to them your situation

I think you should be able to get what you are looking for that way. I really hope this works for you.

If you were able to withdraw funds in April, then I am sure they can give you a letter stating that you have access to that account. If not, do you have any documents relating to your April withdrawal?

You can always call the military help line and see what they think.

Sorry to hear you are having such a problem, especially since your husband is out serving our country in Afghanistan. Do you know if your husband provided you with a Power of Attorney? If so, it may provide you with access to that account in question. A lot of husbands will obtain such a document for their wife's just in case the wife needs to access accounts, pay bills, etc. If you don't have such a document then you need to contact his First Sergeant to help you with this. You are not alone and his First Sergeant will know exactly what to do to get ahold of him. If not the First Sergeant, then his commander. They will do their best to get ahold of him and rely your problem. Please let us know how you fare.

I got a hold of my hubby! Finally! First of all, thank god he's alive.

Now he gave me a new password (turned out he is forced to change it every month or so, that's why i was unable to log in), I printed out what the guy needed and mailed it out today.

I found out that the power of attorney had been assigned to his mom a few months before we got married...

Now waiting for the IO to either resume the case or ask for more (god forbid).
