Hi All,

I am going through an extremley hard time in my head.I got married at 23 and have been married now for a year and 1/2 and have my conditional green card. however without going too much into it within the last 6mnths something just doesnt feel right and even though he a loving husband and would do anything for me, we do have our days and I dont think its fair to him to carry on with the relationship when I have these thoughts in my head. We do plan on going to marriage counselling- i owe him that much.

I was just wondering if i did decide to go throught with the divorce what would happen when i apply for lifting of conditions? At the end of the day, if divorce is something i really need to do and go with what feels right then it doesnt matter if i go back to the Uk as i still was true to myself and didnt keep going at a relationship i knew wouldnt probably last and that i was unhappy in. But I have made great friends here and have a great job.

My removal for condition is dec 2011 so say i got divorced in the next 6mnths would i need to notify USCIS immediatley or would I just stay in the usa divorced antill i have to file? I dont want to annoy them and think i cheated on the system. Would a filing of divorce itself automatcally notify them?

How likely is it that someone gets granted a 10 yr greencard without any problem of beating/abuse, just mereley that it diidnt work out.

I doubt this would happen but what if my avidafit decided to call up now and say she no longer wanted to be an avidavit for me. what then?

Again, my husband is great i just feel like ive fallen out of love with him and it wouldnt be fair to either of us if i stayed having that in my head. I wish i could change the way i feel.

Well im still trying to figure stuff out and who knows, maybe the counselling will work...but please help me on my questions

Thank you

You need do nothing until it is time to file for ROC. If you are divorced at that time, you can self petition for removal of conditions as long as you can prove that you entered the marriage in good faith. It is a bit more complicated, but it can be done.

A sponsor cannot simply call and say they do not wish to be a sponsor anymore. A change of mind is not one of the criteria to cancel the affidavit.

Thank you for your response. How do i prove that i enetered it in good faith? By pictures/plane flights together ect, rental agreements/phone bills car titles ect?

Of course i have all that but it would be a year old by the time the ROC comes around... would that be ok?

There are dozens of topics in this forum or in the "Effects of Major Family Changes on Immigration Benefits" forum on this process. Do your research, contact the ones who have been successful
