Fuhrer Obama's Administration Officially Legally Challenging Arizona's SB1070

As Hotsheet reported yesterday, Secretary of State Hillary Clinton said in a television interview in Ecuador this month that the Obama Justice Department "will be bringing a lawsuit" against the controversial Arizona immigration measure signed into law earlier this year.

The comment was striking because both President Obama and Attorney General Eric Holder had said only that the administration was considering a suit. Arizona Gov. Jan Brewer called Clinton's comments stunning and added that "to learn of this lawsuit through an Ecuadorean interview with the secretary of state is just outrageous."

It was unclear yesterday whether Clinton's comments were simply a prediction or mistake or whether instead she was getting ahead of a planned announcement by the administration.

Now a senior administration official tells CBS News that the federal government will indeed formally challenge the law when Justice Department lawyers are finished building the case. The official said Justice is still working on building the case.

Contacted about Clinton's comments today, State Department spokesman PJ Crowley said they reflected her beliefs.

"The Secretary was asked about the Arizona law during a TV interview in Ecuador," he said. "She believes that a better approach is comprehensive immigration reform, and said so. Regarding how far along the legal review is, that is a matter for the Department of Justice."

Despite the senior administration official's comments, an official at the Justice Department told CBS News today that the question of whether to sue is still under consideration.

The Arizona law, which would go into effect in July, requires immigrants in the state to carry documents verifying their immigration status and requires police officers to question a person about his or her immigration status during a "lawful stop" if there is "reasonable suspicion" that person may be in the country illegally.

No surprise that skyving federals under Zero and Shrillary wish to sue Brewer who had the initative to fill in--in other words, they sue Brewer for revealing the facts about them!

When you own government is more interested in being PC and the feelings of citizens of another country than your own state, this is a good reason for a state to break away.

Why should he care about the Middle East or a country in Asia?

I agree with AZ... but worrying about nations half-way across the world is ridiculous as well.

I was making the point that he has bigger issues and problems to deal with rather than worrying about or working against one of his own states which is simply doing the job he should have already been doing. Thus I agree with Arizona also. :whistle:

There are many things troubling about the Obama administration's priorities and preferences. An overwhelming majority of the population supports Arizona and wants the feds to enforce the laws against llegals. Despite this fact, our Justice Department and our White House act against the best interest of the country in unprecedented and confounding ways. They do nothing to alleviate illegal immigration, and they label our law enforcement officers and supporters of immigration laws as racist and xenophobic.

Most disturbing is how they purposefully encourage negative attitudes among citizens and leaders of foreign countries toward Americans who want our government to protect our borders. Our president stood by and allowed Mexican President Calderon to openly condemn the rightly passed law by a sovereign American state. Our Attorney General denounced it as racist and unconstitutional, and now, our Secretary of State goes to Equador, a foreign nation, not to discuss the illegality of the undocumented immigrants, but the illegality of a state law that attempts to do what the American federal government is constitutionally mandaed to do, but just won't do.

It is in alternately clear that our federal government is not only standing in opposition to its constitutional mandate to protect our sovereignty and our borders, it is also fermenting hostility overseas to the idea that the citizens and states of this country have the right to expect or demand their government to do so. While refusing to communicate and cooperate with Arizona and its leaders, they are instead actively building alliances with illegals and the nations they come from to push against any individual or municipality that dare challenge them.

Certainly, Obama sees himself as a world leader, not an American leader. To this end, the concerns and interests of the world away from the US have proven to be more important than those presented by his own citizenry. And, it is our productivity and the tax dollars it contributes that are funding and fueling this effort to bring not only major business entities under federal domination, but the states, as well, voluntarily, or by force.

We cannot be unequivical about standing against this effort. We cannot allow a belief that our government is benign and benevolent to supercede what is evident by words it has spoken and actions it has taken. One World philosophy is guiding our government's immigration policy, and much more. We have to act against it at every turn.

It is well within the jurisdiction of the U.S. Attorney General's office to challenge any state law that is believed to be unconstitutional. Those who support the SB1070 should have nothing to fear if they truly believe the law is constitutional. I think they are worried because they know when leading constitutional scholars have stated they believe SB1070 is unconstitutional, the law won't hold up to legal scrutiny when challenged in court. Good for the Obama Administration for standing up for our beloved Constitution. God Bless this country and the principles it stands for. :thumbs:

I must have missed the part where foreign nationals from one particular country are allowed to flood the US, disrespect its laws, be responsible for a large portion of crime and gangs [versus others] and then be grated the same rights and benefits of citizens.

Perhaps Ms Live in wealthy upstate NY, hence negligible illegals in her backyard, or yourself can show me where this protection is granted in the US constitution.

Why doesn't Washington enforce the Federal laws, then?

A better way to "challenge" AZ SB 1070 would be to resource ICE to enforce the current legislation and make the Arizona law irrelevant. Why doesn't this administration proceed on that course instead of wasting taxpayers' money on legal action to challenge a law which has overwhelming public support on a national scale?

Why is this administration unwilling to represent the constituents they were elected to represent?

It doesn't sound like Arizona is worried. Governor Brewer is taking action to replace the state AG with someone who has not already spoken out against the law and will act to the best of their ability to defend the law. Arizona appears to be ready for a legal fight.

Rather, it appears that the administration is unsure of itself. Otherwise, they would have had more class and more respect than to accidentally "leak" that they would pursue a legal challenge on Ecuadorean television.

The Constitution is a fine thing. This administration needs to start respecting it and its own constituents, rather than pandering to citizens, and politicians, of other countries over their own.
