I would be getting married in a few days and filing for AOS soon.

One of my professors just told me about a great position that is very flexible and i would be getting paid a lot of money. normally, I would have been able to easily get CPT with my F-1 status which would allow me to work at this new job, but since I am filing for AOS, and would be out of my F-1 status, I don't know what to do?

I mean, I don't know when I would be expected to start at the new job if I get it, and I don't want to delay my AOS any longer than is required.

What can I do? Is it possible to work at this new job while AOS and without the work authorization?

with AOS you can concurrently also file for i-765.

It is the same work authorization application and you get the same EAD card you would get if you filed based on CPT or OPT.

You would just file under a different eligibility category, and you don't have to pay the fee ;)

Takes roughly the same amount of time (2-3 months-ish)

No, you cannot start working without the work authorization. You have to wait.

I would file AOS right away as soon as you get married, and also obviously file for the work authorization concurrently. It will take around 60 days to get it. If they are flexible, they will be able to have you start working just in time for fall quarter hopefully!

Talk to your professor, if they really want you they will wait. Otherwise remember you can still start looking for a job and go to interviews while on a pending AOS, you just cannot actually work until EAD is approved and you have the card in hand.

You can only start working officially once you have your EAD in hand and the start date has commenced.

I was offered an excellent job after graduation last summer. However, the job began began 2 weeks before the official 'start date' on the OPT-EAD. College HR wouldn't relent on the date. They are not going to be breaking any employment/immigration rules.

You can also request expedited work authorization, but that's not a sure thing, certainly. Helps if you can show hardship--that would result from not being able to take a job specifically.

It's my understanding that you don't lose anything on the F1 or OPT until AFTER the AOS is approved -

IE - filing for AOS does not stop any current F1 status.

BUT - that's my understanding about it - I COULD BE WRONG, you should keep digging.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

That's a valid question/point. I've always wondered that myself. I'm on F-1, AOS pending. So what does that make me? :blink:

But in the OP's case (assuming OP has not applied for OPT) it would make no difference if OP files EAD based on AOS or F-1/OPT.

Same form, same card, pretty much same processing time?
