MELBOURNE, Australia - A 20-year-old man is probably regretting his decision to have fresh breath during his assault hearing.

The Melbourne magistrate overseeing his case threw him in jail after the man looked at him and deliberately blew and popped a bubble of gum, according to the Herald Sun.

The suspect was sentenced to 30 days in jail, but was released on an emergency appeal by a higher court

The tough magistrate is known for cracking down on people who misbehave in court.

In February, he jailed a young offender accused of traffic charges after the suspect raised his middle finger in a rude gesture.

I wish it hadn't been overturned. People who flout the law and then behave with that sort of attitude when brought up to face their crimes make me wish we had corporeal punishment as well. Boy, I'm just itching to slap that guy, and I just read 5 lines in a story!!

Gotta love the misguided compassion the courts have there. That idiot should have been caned in the face but nope, instead he is let off.

Word of warning to the US, never ever follow the UK or Australia's sentencing guidelines.

What an education he could have got if he wasn't released!

The reason there are people called judges is so that they can have power to throw people like this where they belong.

Lawyers, policemen or government officials (at least in countries that pretty much adhere to democratic principles)

can not do this, but Judges can and do. The role of judge used to be reserved for the supreme monarch, but

under the principle of separation of powers the functions of interpreting law and handing out sentences have been

given to those who are elected or appointed as judges.

One of the best lawyers I have known said, "a good lawyer knows the law, a great lawyer knows the judge."
