864 vs 864A?

Timeline

If I am living with my mother, who is the owner of the house, would she fill an I-864 or I-864A? Does ownership of the house have any affect on which form she would fill out? Thanks!

7/2/10- NOA1

2/9/11- NOA2 (transferred to Texas)

NVC

2/28/11- case number received

3/2/11- Paid AOS bill

3/5/11- Paid IV bill

3/12/11- expedite to Bogota consulate approved!!!

3/14/11- left NVC to Bogota for further processing

3/17/11- received by Bogota, emailed consulate and was told to send DS-230 and DS-2100 (packet 3)

3/18/11- packet 3 emailed to Bogota consulate, email confirmation on March 23

3/31/11- Interview date! Approved!!!!!!

I think it has more to do with the fact that you are living in the same household... and that she should fill out form I-864A because of that. My husband lives with his father and he had him fill out the I-864A, but neither one of then owns the place, they are renting it, so I suggest you check that with older members on here just to be sure. Hope someone comes along soon. Good luck.

Apr 2010 - NOA2 received - APPROVED

Apr 2010 - got NVC case number

Apr 2010 - DS3032 sent and accepted

May 2010 - AOS & IV Bills received

May 2010 - AOS & IV Bill paid

Jun 2010 - all documents sent to NVC

Jun 16, 2010 - NVC received all of our documents (according to the AVR)

Jun 28, 2010 - NVC sent us a RFE

Jun 30, 2010 - received the checklist from the NVC via email

Jul 01, 2010 - sent the corrected I-864 form back to NVC

Jul 12, 2010 - NVC has received the checklist letter response

Jul 21, 2010 - got SIF, case expedited cause of pregnancy, all the paperwork sent to the US embassy in Zagreb

Jul 26, 2010 - medical

Jul 27, 2010 - interview - APPROVED!

Aug 06, 2010 - POE - Seattle

Your mother fills out an 864A. You fill out the 864 (regardless of income - even $0/year).

Follow the instructions on your 864, it will tell you where to add her numbers and how to do all the math to come up with the final household size and household income.

Ownership of the house does not factor into the 864/864A issue, only when income is insufficient and assets (such as a house worth more than the mortgage against it) come into play.

the instructions for the regular and A have a specific listing for how to do it. the qualifications.

read them carefully and see if she qualifies for A or not.
