File I-130 CR1-IR1 CAN I FILE A K-3 NOW ALSO

Timeline

I filed a I-130 for CR1-IR1 but now can I send in fora K-3 To the service center that has my case since it was only May 19th and received May 25 my NOA 1........ Want to be able to get my husband here the fastest I can. So would appreciate any help with this I can get. Is there extra fees for filing that form as well. If I could get some help in figuring out what to do. I'd apprecaite it.

Darnell, I made a mistake and filed K3, I didnt know that it was administratively closed by NVC. I'm worried about a couple of things, and I appreciate if you can let me know if you can answer any of my inquiries:

-is there a way to cancel/withdraw my K3 petition?

-Would my I-130 approval be delayed because of filing I-129F?

-Would an RFE for I-129F affect my I-130 approval? in other words:

-Would an RFE for I-129F delay my I-130 approval?

-If i ignore any RFE for I-129F because obviously I want to cancel it, would it affect my I-130 approval? would USCIS cancel my I-130 or anything like that?

I would appreciate your help!

10/12/2010?: DS-230 IV package completion

10/12/2010: NVC completion due to APPROVAL OF EXPEDITE REQUEST

10/15/2010: Received by Consulate

10/19/2010: MEDICAL EXAM

1. I've no idea, truly. Talking to USCIS seems un-fruitful. The I-129F is in a queue somewhere, in 'black hole / black box' operations - doesn't come up for air until it's on an adjudicator's desk. Truly, I've no idea. BUT - if a phone call seems useful, by all means, give it a try - call USCIS, get a Human, ask for Visa Specialist, inquire with that 2nd level human.

2. IMO, yes. Once the casefiles are matched up at USCIS, the place in queue, for the I-130, is dropped, taking up the place in queue of the I-129F. Delay from 1 to 2 months. I learned this from studying the timelines here, both on I-130/CR-1 and K-3 timelines, over a 2 year period. Thank god there is data on this, (remind yer buddies to fill out the timeline, please) but is specific only to VJ. There are anomolies, sure, with folks getting RFEs, and 'rapid push' at CSC/VSC, but for the most part, was marked lag of 1 to 2 months, those filing the I-129F

3. Unknown. I've not studied the data points on this, specifically.

4. Unknown. Same Reason.

5. The I-130 would not be cancelled, IMO. The I-129F for K-3 only exists because an I-130 was filed. There are different processing paths on this, but for the most part, no - yer I-130 would not get cancelled at USCIS. It might get delayed, as USCIS tries to keep 'married casefiles' together (I-130 and I-129F) (source - ILW.com ) but if they casefiles ARE married up, then is possibility that the I-130 will be 'held' with the I-129F until the 'expiration date' on the RFE 'submittal date' (must submit by date) occurs.

(Hope I got all these terms right ?!! )
