But $20 billion is neither a floor nor a ceiling on their potential liability.

Obama called the $20 billion escrow account a "good start" which clearly suggests they might go after them for more.

I'm sure they'll fight it, but picking a fight with the US Government is not something you want to do.

The liability is that of BP North America not BP Plc

If O pushes too hard, Bp Plc could walk away and say keep it - and stick a cork in it yourselves Congressmen..

There isn't much oil left in the US anyway and a lot of it is on the beach so ta ta

Half the shares holders are US pension funds...so he is whacking the homies as hard as he is whacking the Brits

Less income all round, less tax income from BP america and the US pensioners and a hostile ally. After November he will take the pressure off behind the scenes and let those Republicans on the South coast keep their share of the 20 bill but no more.

It's not a good deal to keep going with this.

Okay, so it's a common or garden Inc. Yeah, BP will well and properly have covered its ####### in structuring it's subsidiaries. The plc is safe, as it should be. Sorry if I sound like a cow but it is in the interests of its shareholders to limit its liability like this.

and it's shareholders are us all if we have unit trusts or mutual funds holding our pensions assets... or if we want our governments to have tax income from BP and it's shareholders rather than more from us or less government services

All the anti oil company people were anti oil company before the spill and they would admit that if they were being frank. Frank is very anti oil companies.

No point being anti capitalist and living in a capitalist country. Send em to .... er where isn't capitalist nowadays ?

I am a capitalist but in favour of strong regulation of their operations via world wide regulation through co-operation between countries as they do with tax now.

I wish the US had stronger advertising standards as the methods used and the claims made would not be allowed in any other first world country. Free speech doesn't include scamming people with all the snake oil ads and guys hanging upside down to make their hair grow back

If that worked then all the guys in austalia would look like ken dodd

I'm going to respond to the original post question about "would you go back?".

If my husband died or left me, I'd be back in Canada so fast my head would spin!!!!! I have U.S. and Canadian citizenship, and I would rather live in Canada than the U.S. without my husband.

Seems that if people are in a position to go back - ie no kids or other family here, they would go back

Especially if it is to a first world country

Lack of family must be a big chunk of that thinking but how much is the US itself - and of that, how much is just practical - health care etc, and how much is the culture ?

I can handle the culture as I can always get BBC radio 4 online to find out what is happening in the world. Health care on your own and not in a pool is aaarrgghhh ! I would like to think I could handle a rented condo in Florida while I found my feet, but the call of home is loud when one's personal life takes a header.

I know of one lady who was widowed in Australia after 40 years there and she sold up and came 'home' to the UK and bought a little terrace house in Lancashire as that's all she could afford what with the exchange rate and UK house prices. Most of her old pals had died and a lot of her neighbours didn't speak English and it rained and it rained.

Bad move.

Good, good, I continue to rack up points in the "All Flattery, All the Time" stakes with Alan.

I work for an organisation that is all about sustainability through good and practical governance. The fiduciary duty that a board holds to its shareholders is slippery -- is it better to contain risk by limiting exposure to companies that are in potentially risky areas (BP for example) or is it better to work with the company to help it contain its risks and exploit the gains that can flow from risk? I won't bore everyone to death, but in the Anglo-American model this is still undecided and left to the board (the Freshfields decision notwithstanding in the UK at least). I'm amoral, personally, about the dealings of a company as long as they are legal so long as they are done in such a way as to maximise return to their shareholders. I am still undecided on minimising effects on mere stakeholders, especially if it is done to the detriment of the shareholders.

However, on a personal level, I find the whole thing tragic and indicative of major structural issues at BP that clearly need to be addressed. Said it before -- huge opportunity for them to get this right and be the standard bearer for the world. I hope they take this opportunity and run with it. :(

And yeah, sorry to have nudged this even further off topic. :(

You'll have to check with Val and Owl, but I think you're pretty safe with those two. I'm blissfully amoral in my feelings about the market on a professional level; I'm a softylefty though in my private moments, when I sit at my dressing table, brushing my long hair with the gorgeous Mason Pearson set you left in my boudoir (ta muchly, nothing like boar bristles), and feeling dreamy.

That was MY ex-MIL. The one who found having an American as a DIL an embarrassment, and who is now living the good life with her odious husband in their Tuscan idyll. God, the stories I could tell about that woman. She was very senior in the Civil Service, got appointed a Commander of the Bath, and would parade us around as her charming and brilliant son and his equally charming and brilliant wife at these Order shindigs at the Abbey (don't know how else to describe them, quite surreal) but after we left the claws would be out again.

I'm so glad I don't have her in my life anymore. It was terrible.
