Save your self a headache and the need to get photo copies, just get the tax transcript it's free and they can fax it to you. Than you don't have to worry about attaching copies and if you attached the right one and what not...

I know, I wish I could do it. But since the joint-sponsor decides what to do, it doesn't depend on me! :)

With the photocopies of the 1099 forms I have we surely cover the 125% of the poverty line, so we're fine :)

One more thing: so far I checked the forms 1099 attached to the tax return. The forms show an income of x dollars (well above the 125% poverty line for a family size we consider) but the tax return is filed for y dollars, about 10.000 usd more than what the 1099 forms I have here account for. Will this be a problem? The missing forms are about dividends from I believe shares and a trust in my joint sponsor's deceased husband. Since the forms attached show that we have more than the 125% of the poverty line anyways, will that suffice?

One more thing: so far I checked the forms 1099 attached to the tax return. Some of that income may not be taxable thats why it won't show on a return, your OK just explain if there's an issue the consul are pretty profcient in tax issues

Yeah, i asked whether the joint sponsor must submit a tax transcript or the form 1040 is enough.

the primary sponsor won't have a tax return because she has no income since she is a full tiem student.

Hi,

When I said "did you ask the joint sponsor" - it was because you stated that the slips do not match the income earned. I meant, did you ask her/him why - if you are missing a slip.

I had also mentioned that you were interpreting the instructions incorrectly (re the W2s) - but no matter!

I don't know if photocopies are acceptable or not, so I can't answer that, it's probably consulate specific anyway.

Rob should not be the one explaining to the consul, in my opinion - the co-sponsor should explain it, in the form of a note attached to the I-864.

I'm sure it's not fun to quiz your co-sponsor on exactly where all their income comes from, but that's what you need to do. If the officer at the consulate asks you, you want to be able to respond confidantly. It's clear from what you are posting here that you don't understand their return and why the numbers do not match up. If there is non-taxable income in there your co-sponsor should be able to explain that and then you will know.

It's not consulate specific it's the Law as stated in the AFM copies of return OR transcript it actually tells you NOT to send originals unless requested

This is the DCF forum - the OP will be taking the information with him TO the consulate, not sending it.

No, all the income is in the return. but for those trust dividends there are no 1099 forms attached. there are 1099 forms of all social security benefits, pension payments, and bank interests though. But the tax returns were prepared by a qualified accountant, so I guess they are correct. I will quiz her anyway to make sure.

But could this be a problem?

Sure it could.

If you think about it - you present the sponsor's tax return to the consulate officer. They look at the 1040 and the slips and the income on the slips is not sufficient to show what is on the return. You are providing a key piece of evidence for the I-864. It is important that you provide all the pieces.

Either provide more slips or have the co-sponsor explain it in a note - at the very least you need to understand why so you can explain it.

I agree with that. But one question: since the income proved with the slips is already way past the 125% poverty line, wouldn't that be ok anyways?

Yes, if you provide transcripts you don't need slips.

The IRS will even fax that transcripts if you request it and have a fax handy.

But the I-864 doesn't say I can provide tax transcripts... I cannot find it! And, also, if I don't have some slips but the slips I have are enough to prove my joint sponsor has enough money (more than 125% of poverty line), wouldn't that be ok?

LOL it did help me but was meant to help you... I am aware this is DCF the same process i just went through and being retired also I questioned the very same things as the Op - it is not the job of the consul to determine if tax reports were submitted correctly or not, they are accepting the return as true under the penalty of perjury, the 1099,s and other proofs of income are suplimentary to bolster the return, dividends almost never have a 1099 because they are not earned income ;)
