hello to all again..

i just wanted to ask you guys if getting a california drivers license while in a tourist visa was illegal.i got itthrough getting a denial letter in social security office..and sign there that i will not use it in employment purpose.which i did not use it for that...does anybody here did get one too?im in a k3 petition now.the last trip to US which was 2004 i was refuse entry.i had 5 year ban and they cancelled my visa for the immigration officer suspecting me that i worked in US.they were asking me why i went 3 times to US already in between 2001 to 2003.its like travelling there every year.and stayed for 4 to 5 months each travel..so they suspected that im working there.. so i was sent back home on the available trip back here in our country. just wanted to know and ask your opinion guys about if i will have a big problem on my interview as a spouse now.should i really need to file for a waiver?does any body here knows someone who had a 5 year ban and never needed to file waiver?and just gave her spousal visa without any question about the ban or bar thing??pls help!im so confuse and worried.... :(

You will be denied due to the ban. You should have a waiver ready to submit when you go to the interview.

You will be denied due to the ban. You should have a waiver ready to submit when you go to the interview.

If they gave you a 5 year ban and cancelled your visa, you either have to wait out the 5 years and reapply, or you will need a waiver at the interview when you are denied. Your K3 petition should be approved.

The fact that you somehow received a valid CA drivers license should not affect you in any way.

thanks for the info and advice...i just wanna say that how could the immigration officers could do such thing as sending people back home without doing anything bad...its really a big trauma for me.i did not do anything wrong and now its most likely i will be needing a waiver for the banned i have...i really feels sad for m situation...is there any case that you know that had a ban and did not need a waiver?i mean if the consul here will see what happened did they do considerations??thanks guys for responding..god bless!

You may not have done anything wrong or illegal but to the immigration people, your being able to stay in the US for 4-5months each travel showed that you do not have enough ties to the Philippines. Do you not work or study in the Philippines?

thanks again for replying...i finished my studies already and im not working at that time.what i do is i buy things in the states like bags shoes perfume and wallet and send it here in the philippines through boxes of LBC or fedex sometimes...We have a small business here in the philippines which we sell imported goods..I already have kids here in the philippines that time and my kids has tourist visa too.they travel with me the first time and 3rd time i went there...so maybe,that refuse entry will really happened to me..i just need to do what i need to do now..i just hope that filing a waiver wont be any problem for us.But if i file the waiver after the visa was denied will it take more time again to wait for it to be approved?if yes?how long?

This is kind of late to be responding, but I hadn't checked the site in quite some time.

My husband was given a removal order for 5 years back in 99 and he and I waited out the ban and were able to get his K3 visa through Ciudad Juarez embassy in May 05. It can be done, although the 5 year wait is brutal. If I knew then what I know now, I would have gone ahead and filed a waiver and got a K1 visa (since we weren't married at that time) for him, as the waiver approval rate is very high in Mexico. I don't know what it's like in your country, but it's something for you to consider. Don't expect to not be asked any questions about the ban though. There will be questions and many of them, even if you do wait out the 5 years. We went through the story with 3-4 different people before he was given the visa, and had to have lots of fingerprinting done to prove he hadn't reentered the US in the ban period and that he didn't have any other things against him except for the ban. He was given the removal order/ban because they said he was trying to enter the US to work - which he wasn't, but even so the ban stood. It wasn't easy to go through all of that, but our relationship is better off for it now. Best of luck to you, and I pray that God will give you all strength and wisdom.

05/05 - Entered US
10/3 - Mailed I-485 and I-765
10/14 - NOA1 for AOS and I-765.
10/22 - I-485 Biometrics NOA received, appt 11/15
10/27 - Touched on both I-485 and I-765.
10/31 - I-765 Biometrics NOA dated 10/24. Appt on 11/29 at 12PM.
11/15 - Biometrics for I-485 and I-765 done on same day.
11/16 & 27 - Case "touched" on bcis.gov.
12/7 - EAD approval by e-mail. Card is on its way. Thank you Lord!!
12/12 - Received EAD.
1/9/06 - Applied for SSN. Received 1/17
3/30 - Got our AOS Interview notice!! Interview date 5/31
5/31/06 - Permanent residency granted! Passport stamped IR6. God is so faithful!

2/2/16 - Mailed in N-400 paperwork

2/10/16 - Received text that N-400 paperwork was received.

2/16/16 - Text that fingerprint appointment has been scheduled.

3/1/16 - Biometrics interview, Naperville, IL

3/11/16 - E-notice that case is in line for an interview

7/8/16 - Text/site updated that Interview date has been assigned

7/14/16 - Received letter dated 7/11 with interview date on 8/11
8/11/16 - Interview, given paper that said passed test but no decision can be made at this time.

10/18/16 - Received text, status online updated to say oath ceremony has been scheduled!!!!

If you stayed in the US for 4-5 months at a time, that is an overstay and it's illegal. That falls into the 'anything bad' category.

If you stayed in the US for 4-5 months at a time, that is an overstay and it's illegal. That falls into the 'anything bad' category.

How do you figure that is an overstay? This isn't the VWP. 6 months is a normal amount of time granted at the POE for a B2 visa.
