Hello,

i need some help on how to file the affidavit of support

me and my wife messed up the first one and they where asking for a new one so we want to be sure its all correct this time

ill try to make the story as short as possible so you can see where my problem is

my wife is unemployed but since she filed the I 130 she has to be the sponsor on the affidavit of support

since my wife has no income and we are currently living with her mother and stepfather the most logical option would be to combine the income of her mother and stepfather with hers

which is according to the step to step guide on the affidavit papers not possible since her stepfather had a different address than she and her mom on his last tax return

her mom and stepfather are going to file together this year though since he moved here

anyway

what i want to know is should we just combine her income with her moms and stepfathers and hope it goes thru like that even though his address is different

or have her mom file as a joint sponsor since its possible to combine her stepfathers and mothers income that way if i understand everything right

you might be able to tell that im quiet a bit confused at the moment but this has been giving me a headache for days now i was going to call the support center tomorrow to see if they can give me any help with this but in the past this forum has me helped out a lot and hope i can get some help with this to

We had my husbands Mom joint sponsor me.... she just had to complete a I-864... she did not live at the same address as we did... but we did not combine her income with my husbands... it was 2 seperate forms

Who can be a joint sponsor, and when is a joint sponsor allowed?

If the visa petitioner's household income is not sufficient to meet the requirements of INA section 213A and 8 C.F.R. § 213a, INA section 213A permits a joint sponsor to sign an affidavit of support, in addition to the affidavit of support signed by the visa petitioner. A joint sponsor is someone who is willing to accept legal responsibility for supporting your family member with you. A joint sponsor must meet all the same requirements as you, except the joint sponsor does not need to be related to the immigrant. The joint sponsor (or the joint sponsor and his or her household) must reach the 125 percent income requirement alone. You cannot combine your income with that of a joint sponsor to meet the income requirement.

my wifes mother lives at the same address as does her stepfather now but on his most recent tax return he has a different address (the bold part)

i guess what i want to know is does her mom have to be included in my wifes I 864 and file the I 864A since she lives at the same place or can she be a joint sponsor and file a I 864 so we can include my wifes stepfathers income with her mothers

Did Mom and stepdad file a joint tax return? Why did stepdad have a different address in the past? Were they not yet married?

no they filed seprate tax returns and they have been married for a long time now

to be quiet honest i dont really know why his address was different in the past they are going to file a joint tax return this year which doesnt really help me since i have to use last years tax returns

So what? At the time of submitting the I-864 he is living at the same address - correct? The tax return is for verifying past income, not for establishing current address.
