Oh Monica, I am so sorry. I figured you two had an approval for sure. This is really bizarre... I am so shocked right now. It makes me question why my husband (then fiance) was able to get approved with ease... I will pray for you, my dear. Please do not lose hope. You two will be together again soon, ISA.

What he actually said was, "We are sorry, we can not give you the visa. But this is not the end, you can get the visa under other conditions" The first statement is what i understood over the phone...i have sinse spoke with Hicham online...easier to get exact words that way :)

Hi Monica very sorry to hear your news ... I'm like you I just don't understand what does it take to prove the relationship to these people!!!! They know nothing of your life and they sit and judge everyone so harsh. The day I sent an email to the consulate and got a response back the next day saying that they sent the case back (it's funny the same day as my email) was sent!!! I contacted my senator who did a inquiry on the case and got a letter from the consulate stating that the case was not denied but returned for review and they also stated that my fiance was treated very fairly and with respect. What a joke!!!!

Monica, I too am so sorry. I was hoping for some good news and a turn around with this consulate. They would get tired of hearing from me. I would keep calling and e-mailing. What puzzles me is the fact they tell you guys to go get married and file CR-1 but then, not all CR-1's get approved and its not a given. A CR-1 will take you almost a year. Stay strong and positive.

The phrasing of that makes me wonder if it was some kind of trick wording, wherein they were looking for him to say something to the effect like, 'it's not about the visa; it's about me being able to be with Monica and her daughter', etc, etc, or something like that. I don't know; it's just an odd phrasing.

His petition was returned to the Department of Homeland Security's Bureau of Citizenship and Immigration Services (USCIS) on June 14, 2010 for further review. In order to seek information on the status of the case, you should contact the USCIS National Customer Service Center at 1-800-375-5283. However you are advised to wait a few weeks before contacting USCIS to allow them to receive and review the file.

Due to the personal nature of the information, the file was sent via registered diplomatic pouch.

They can't say it's a denial which is why it goes back to the USA. Depending on your service center you could get a NOID and have a chance to fight it, expired/closed notice or nothing. Since it is still in Casa, FIGHT IT NOW !

Hmm, well, I guess what the CO said to Hicham about there being other steps makes a little bit more sense, but I'm still confused about what is happening to your case. Is this some kind of administrative review?

I guess they don't like using the word "denied"!

I would reply and ask them to provide you with the specifics as to why it was sent back for review.

They can't say it's a denial which is why it goes back to the USA. Depending on your service center you could get a NOID and have a chance to fight it, expired/closed notice or nothing. Since it is still in Casa, FIGHT IT NOW !

:thumbs: definitely don't give up on keeping it in Casa. It's unlikely they sent it back yesterday. Have you gotten in touch with your senator or congressman? What are they saying?

faxed release to senator...the person at the congressman's office is back in today...will call when they open in 1 hr...will be a LONG hr...so there is a chance to get it turned around there? From what i've seen, if it gets back to the US it takes many months to get anything done on it...am i thinking right? :help:

Yes, if it's sent back, it will take a while for them to do anything.

In the hour you have, read the pinned thread above. Kiyah did an incredible job researching and posting the information she found. You will likely get the best information from there. Since you have the hour while you have to wait for the senator's office to open, it's a great way to spend the hour! :)

That's a denial of the visa. The approved petition is sent back to USCIS with a recommendation (by the Embassy) to be revoked.
