Hello VJ Family!

Ok, here's my dilemma... we went through the whole fiance visa process and all went well. We just married on May 9th of this year. I am still currently waiting for our copy of the marriage certificate. My only concern is that on his I-94, it says June 23rd, in meaning that when we both entered the U.S., we should be married by then, in which we did. However, I fear that we will get our copy of the marriage license too late before I am able to finally file my fiance's AOS. Will he be out of status?

Also, the visa itself, in his passport, has a seperate date that doesn't expire until September.

I'm not sure what to do anymore. PLEASE ADVISE! :(

First RELAX B-) as long as you married within the 90 days of arrival you are safe. The visa expired the day your husband arrived, the I-94 expires 90 days from arrival. It's highly recommended to file for AOS as soon as you can. Good luck on your journey.

09/2009 - NOA 2 approved

12/2009 - Interview (2nd time) APPROVED! VISA ISSUED

02/2010 - Arrived USA

4/19/2010-Sent to Chicago Lockbox

4/26/2010-Received texts and emails 7th day

4/30/2010-Received NOA's(Hardcopies) 11th day

5/3/2010-Received ASC appointment notice(mailed 4/29/2010)14th day

5/7/2010-Walk-in Biometrics done(2 weeks earlier)18th day

5/13/2010-Case transferred to CSC

6/2/2010- Case received/resumed at CSC

6/18,6/22,6/23 AOS touches

6/28/2010- EAD production and touch on AP

6/29/2010-AOS APPROVED

7/2/2010- 2nd update on EAD production and touched on AP....

7/6/2010- Received "Welcome Letter" and AP document

7/12/2010-Received GREEN CARD and EAD

i got here in US Feb 28,2008 and married April 5,2008 and we file for AOS January 17,2009, Biometrics Feb 12,2009 , received my working permit march 15,2009 and got my green card March 30,2009 and everything went smooth. so relax everything will be fine :)

Ok, I'm going to relax. Also, I noticed that with the AOS process, it's $1,000 dollars and more? Is this true? I'm not complaining, but just want to make sure.

Yep $1,010 to be exact. And apparently the price is going up soon (couple of months or so) so the sooner you can file the better. $1010 is expensive enough I think!!

Also yes, there is no deadline to file AOS BUT remember to keep in mind that there IS a time limit on the validity of the medical. So if you wait too long you'll need to pay for another medical too, and depending on where you're from that could be expensive too and just add to the crazy price of AOS.
