Name to use for AOS (I-131 specifically)

Timeline

Hi everyone,

We're starting our AOS packet now from a K-1 visa. My new wife plans to change her name, but hasn't yet. She has a social security number with her maiden name.

What name should we use in the packet? Her new (planned) name, even though it doesn't match her passport, visa, etc.?

Especially concerned about the I-131 Advanced Parole, as it's sort of separate from the rest of the AOS packet. Should we use her maiden name as that will match with her visa?

You should file all of the paperwork in the name you want to be on the green card. It is a big pain to change it afterwards.It is fine that her documents show her maiden name. You can start getting those changed to her married name, and you will probably be finished before AOS is approved. Good luck! :thumbs:

hi there...she is now married to u so she can already use her new name for her AOS application..its fine if it doesn't match her passport and visa..its understood that her passport/visa will show her maiden name especially so she came to the US under K-1 visa..just make sure u won't forget to include a certified true copy of your Marriage Certificate in ur AOS packet..

05-12-2010 ---- Interview Schedule in Milwaukee..PASSED!!! Thank You Lord!

05-17-2010 ---- Welcome Notice arrived in mail

06-01-2010 ---- Received Instruction Permit Card from DMV

06-10-2010 ---- 2-yr. GC/PRC arrived today in the mail..SALAMAT PO LORD!

12-12-2010 ---- Got my DMV License

And when you travel with the Advance Parole or green card, carry a copy of your marriage license to explain the difference between the name on the passport and the name on the green card or AP.

The visa is over and isn't an issue about names any more since it has had it's one time use.

As mentioned above, you guys are now married. Name to be used is her new legal name [if different]. She can change her SS when she receives her GC. Since she has a Brazilian passport, she can contact her embassy and ask process needed for new passport. She will have to file her marriage in the Brazilian consulate, and then she can apply for her new passport..

AOS, EAD and AP must be submitted with her new name if changed.
