Has he been out a status for 6 months or is he still legal right now? If he is overstaying right now I would think a AOS would be hard to get.

1/18/2006----Arrived in Egypt to visit my love.

5/11/2006----Sent I129F.

6/15/2006----Recieved NOA1.

6/22/2006----Recieved RFE (IMBRA).

7/12/2006----Replied to RFE (IMBRA) Sent back.

7/17/2006----Our 1 year Anniversary!!!!

7/19/2006----VSC recieved RFE (IMBRA).

7/20/2006----touched

8/18/2006----touched

8/18/2006----NOA2!!!!!! THANK YOU GOD!!!!

8/18/2006----VSC sent our petition to NVC.

8/19/2006----touched

8/22/2006----NVC recieved our petition.

8/25/2006----Recieved NOA2 Approval letter in the mail.

9/24/2006----I emailed the Embassy reguarding my fiance's packet 3.

10/17/2006--Cairo sent packet 3 for the second time to my fiance. First one was never recieved.

10/19/2006--Packet 3 recieved.

12/20/2006--Packet 3 sent.

12/21/2006--Cairo Embassy recieved packet 3.

2/21/2007---Packet 4 recieved.

3/12/2007---Interview (He Passed)!

3/12/2007---Administrative Processing begins.............God please help me get through this!

7/17/2007---Our 2 Year Anniversay!!!

10/23/2007--7 months and 2 weeks of A/P and still waiting..........God help me!

4/22/2008---2nd Interview ( keep us in your prayers)

4/22/2008--He was approved for the Visa 2-3 weeks until he recieves it in the mail lets hope so!!

6/03/2008--VISA IN HAND! Thank you god!

7/03/2008--Our Wedding Day!

We were told because hes been here for so long (almost 6 months) that if he left the country he would be denied entry even with the K1 and possible banned for up to 10 years, so we are going to apply for the K3 and just get married before his 6 months are up and adjust his status.

It doesnt make alot of sense to me either but this is what we were advised to do by the immigrations people.

We were looking into the K3 anyway because we thought the K1 was going to take forever, which is why we went to her in the first place, and it ended up being what she wanted us to do.

And no I never got an e-mail and the website didn't update that we were approved or even touched until today, but the approval date was the 1st of the month.

If he is still here legally, I believe aussiewench told you you could marry on his VWP & adjust status.

A K3 would require him leaving the country.

If you get married now and file the I-130 he could possibly adjust status in country without a problem although there may be issue of whether or not they believe you had intent when he came into the country.

K3 is if he is not here in the US. Not sure what happens if he leaves you start all over - seems like a waste of a time now that you are approved.

I called her this morning to double check that I understood everything correctly and am just waiting for her to call back.

We were married in Washington in August, we submitted our I-485, I130, I765, and I131 in Sept of 06 to the Chicago Lock Box, and got our Green card in January 07!!! Found this was much faster and easier than going through the K1 process.

good luck. God, i hope you do this right. I am sorry, just being here in your arms every day and then a mixup for bad advice would be horrible. I would suggest you get multiple opinions (I mean professional) before making that decision. I dont mean to be pesimistic, but a ban would be terrible....Good luck!

3/11/06 - 3/26/06 Visited my baby in the PI's

3/29/06 - K1 packet recieved at NSC

6/01/06 - Redirected to CSC

6/14/06 - CSC e-mailed confirmation on the reciept of file

6/23/06 - They they sent the IMBRA RFE

7/03/06 - The emailed that the IMBRA RFE went out on 6/23/06

7/03/06 - I received IMBRA RFE

7/05/06 - Touched

7/06/06 - Delivery Confirmation from the Post Office RFE recieved

7/11/06 - Email notification from CSC that IMBRA RFE Recieved

7/12/06 - Touched (but was to respond to an email that only said 'request recieved and will be processed within 30 days. argh)

7/13/06 - Touched

NOA2 September 11!!!

10/18/06 - Received at Embassy

12/23/06 - Recieved package with interview/medical schedule

01/08/06 - CFO interview/(pre-departure class) Complete

1/11/07 & 1/12/07 Medical complete

02/05/07 - Interview!!!

2/7/07 (2/8/07 manila) - Informed we are approved...3 days after interview.

2/12/07 Visa Received

2/16/07 Baby arrives in US!!!!!

4/14/07 Wedding

That still doesn't sound right...why wouldn't it be just an AOS - with no need for a K3? I would def go ask in the K3 forum here. Or find Aussiewench & PM her.

So nothing at all to do with a K3.

You need to either do a lot more reading so your are gfamiliar with the terms and processes or get a Lawyer or both.

A K-3 is a visa. A visa is for entering the US. I think you have your terminologies confused & maybe the "immigration workers" did that.

I also think they gave you dodgy info about the overstay; Canadians have different rules than other foreign nationals.

Oops, also, just 'getting married' does nothing to protect his status. There are a few things that you should check out further--make sure *you* understand what you're doing so there's no stink bombs waiting to go off in the future.

If he is here legally, then why is there a concern that he will be banned once he returns?

Either there's more to this that you're telling us, or we're just not understanding what you're telling us.

If you try to marry and adjust status, they will see that you had a K1 petition on file, and therefore his motives for entering the US would be questioned, and the AOS would likely be denied.

I'm still not sure why he can't go back & proceed with the K1.

K-3 is for spouses who are out of the US.
