Timeline

So today we went and sat down with the Congressman and his Immigrations Person (Norm Dicks is a family friend), and we were told to cancel our K-1 and apply for the K-3 because of our situation.

So after spending a few hours together coming up with all the paper work needed to apply for the K-3, we come home to find in the mail our K-1 approval letter!! How ironic is that hahahaha.

But anyway, We were approved, even though were changing Visa's I thought I would share so people know that CSC is still passing out Approvals!

We were married in Washington in August, we submitted our I-485, I130, I765, and I131 in Sept of 06 to the Chicago Lock Box, and got our Green card in January 07!!! Found this was much faster and easier than going through the K1 process.

9-25-06 Interview: APPROVED!

7-2-07 Green card received

9-12-08 Filed for divorce

12-5-08 Court hearing - divorce final

This is odd for sure. Fast approval and you reject for another process?

Sounds like he is in the US, they are going to marry and he is going to adjust here.

Nothing to do with K3.

But I may be wrong.

We were told because hes been here for so long (almost 6 months) that if he left the country he would be denied entry even with the K1 and possible banned for up to 10 years, so we are going to apply for the K3 and just get married before his 6 months are up and adjust his status.

It doesnt make alot of sense to me either but this is what we were advised to do by the immigrations people.

We were looking into the K3 anyway because we thought the K1 was going to take forever, which is why we went to her in the first place, and it ended up being what she wanted us to do.

And no I never got an e-mail and the website didn't update that we were approved or even touched until today, but the approval date was the 1st of the month.

I know i'm freaking out a bit now.

I'm being told to do the k3 which i'd like to do because then he wouldnt have to leave...but now that i'm approved for the k1 i'm wondering if i should stick to it, but then he would have to leave and possibly get this ban! And i have no idea how long it takes after this approval for the rest of the k1 to process so who knows how long he'd be gone...blah And basically we have less than a month to figure it out because he has to do something before the 6 months is up.

I'm already a paranoid person but this is really getting to me and i feel like i'm going to freak out...blah :(

So if you stay and get married, he won't get kicked out? Is that what you're trying o say? I thought even if you had a K3 application in progress you still had to wait for a visa before entering with your spouse, or am I mistaken. How does this work?
