Amending pending I-129F to change consulate

Yodrak,

You are clearly the "voice" of reason and reality on this site. Everyone knows that.

With that said, You are not clear on this point.

Embassy = Capital City

Consulate = Major city

"Consular Section" = the department within the Embassy or Consulate that deals with Visa issues.

With that said, Most U.S. Embassies and Consulates have a "Consular Section", not all though, that is true.

Of the 60 odd Countries I have worked in, Nearly all had a "Consular Section", happily processing Visa's.

For clarification: That is not to say that all locations in the world have this service available, but most do.

I would suggest, due diligence on the part of the petitioner, to learn the specifics of their particular countries availability of Visa service, at the Consulate level. With specific respect to their geographic location within that country.

Good distinction, but K visas are issued by immigrant visa issuing posts which in some countries are located in the consular section of the embassy and in other counties are located in a consulate.

the term 'consulate' used to refer to either the consular section of an embassy or a 'stand-alone' consulate is appropriate, I think, and helps to avoid some confusion about embassy v consulate and where the IV post(s) for a particular country happens to be.

What??? What if she gets her interview appointment before then? Who will be receiving her mail there? Are you using someone else's address to shortcut the process?

Nope, we really are considering to relocate in Mexico. This has nothing to do whether it will speed up the process or not. We just want to avoid the complication of having the interview in Manila and flying back and forth Mexico. This is because even if we get an interview for K-1, it does not guarantee us that the visa will be issued. We still have a pending I-212 petition which will most likely delay the issuance of a visa. In short, we want to do this to be together earlier without affecting our pending petitions.

If you are relocating to MX, why bother with the I-129F? Unless... you're planning to marry in the US and then move to MX.... you're really sparing the facts here....

Moving to Mexico is not a long-term plan. We will only stay there until the K-1 visa is issued, but it will not happen until I-212 is approved. We are marrying in US and living in US once we have the visa on hand. We are choosing Mexico because it is closest to Texas.

Embassy in Mexico for the K-1 interview.

It's an option to relocate in Mexico so we can be closer together. The lawyer said we need a mailing address in Mexico to do that.

Let me see if i got this right... ur fiancee will be moving from manila to mexico and you want her to have her interview in Mexico?

If that's the case, you can send a fax to the service center where you filed your petition informing them of the change. Instead of forwarding it to Manila embassy, they will forward it to the embassy in Mexico.

That's what my fiance did. I was supposed to have my interview in Dubai, UAE and then later change it to Manila before the petition got approved. However, the real cliff hanger there was waiting if they will actually send the approved petition to the right place because it was impossible to talk to someone and confirm that they got our faxed request.

Curious is all. I would guess the process (in theory, practice looks pretty random) would be quicker from Dubai than Manila. Just a hunch though!

Unfortunately yes, and it looks like I-212 will delay the issuance of the visa. This is the best option we can think of, so we might want to do it if the lawyer agrees it is best for us and our pending petitions. We should be able to finalize and decide everything tomorrow.

Something came up and had to go home. As expected, my employer wasn't too happy about what I did and banned me. I can't go back to UAE anymore.

The timeline in Manila isn't bad. It's just three months form the time the Manila embassy got our petition to the interview date. That way, I get to spend more time with my family and get the necessary documents that i will need for the interview and whatever else i may need when I get to US. It's difficult getting everything if I stayed in UAE.

Also, here, Filipinos will be the panel of physicians. That's more comforting than having to face other nationals for my medical (no offense folks). B)

I would hope that a consulate has a consular section? Is it an over-simplification to say that a consulate is a consular section? Or maybe to put it in the form of a different question, what sections other than a consular section might a consulate typically have?

I do not understand from this post what point I am not clear on. As for the additional definition that you've added of a consular section being the department that deals with visa issues - yes, that's one thing they deal with, if they have either a non-immigrant visa unit or an immigrant visa unit or both. But typical consular functions also include US citizen services, correct? So a consulate (or embassy consular section) may be more than a visa issuing post? Or alternatively may not be a visa issuing post?

Yodrak, Yes, that is an oversimplification. A Consular Section is an office or a department, within the building.

A Consulate or Consulate General is a facility within a compound.

Under international Diplomacy, every country that exchanges Ambassadors, is allowed one Embassy, which is located in the Capital city. In other major cities within the country, you are permitted to place a Consulate or Consulate General (the missions vary).

This facilitates most, if not all Embassy business in other geographical areas of the country.

Look at the Indonesian Diplomatic presence in the US for example, the Embassy is in D.C. and the Consulates are located in NY, LA, Houston, Chicago and San Francisco.

If their were only one Indonesian Diplomatic facility within the country, it would create hardship for those in the rest of country.

Aside from the Consular services, what they do at the Consulate's varies by country, location and so forth.

Some large Consulates perform many of the functions of the Embassy.

I do not understand from this post what point I am not clear on. Yes, what you say makes sense and thanks for the additional insights.

Perhaps I'll have go one step further and start using the term Immigrant Visa Unit rather than consulate to describe where one applies for their K or immigrant visa.... Unfortunately I suspect that that will be even more confusing to the average VJer, many of whom use the term 'embassy' when they are talking about a consulate. Something to consider, though.
