is it possible to renew a foreign passport with expired visa?

so my wife has an expired visa, but we are in the green card process right now, with the internet in July. but her Russian passport right now is expired, and she'd like to have a valid passport for them to stamp when the interview is done. is it possible to have her passport renewed right now?

I don't see why she can't renew her visa. She should be able to. Some country's embassies have different requirements such as having to be there in person, which can be inconvenient if the nearest embassy is far away. That's something you have to ask the embassy about.

But I'm sure it can be done and expired visa shouldn't matter ..

Better check with your local Russian consulate. My wife renewed hers two years ago and it took almost 6 months. I think the procedure may have changed recently.

I don't see why she can't renew her visa. She should be able to. Some country's embassies have different requirements such as having to be there in person, which can be inconvenient if the nearest embassy is far away. That's something you have to ask the embassy about.

She's wanting to renew a passport not a visa. It's common for a passport to have one or more expired visas. Mine will have several when I next renew it.

Don't know about the Russians, but a German citizen cannot get a new passport from within the US without a Green Card or valid proof of legal presence. Why are the Krauts enforcing US immigration law? I have no clue . . .

The Chinese Consulate in San Francisco asked for a copy of the visa pages and green cards for my wife and daughter when renewing their passport too but I don't know that they would have refused to renew the passports if they were missing either or both. I suspect they would renew their own citizens' passports anyway and that they request the documentation as a matter of routine and/or they simply want to know and document their citizens' US status for their own reasons.

If I were in China illegally and needed a new passport to return to the USA, I would certainly expect a US Consulate to issue me one because I'm entitled to it regardless of my status in any other country.

Hmm actually now that I remember, the Indonesian embassy is the same way.

Last time I renewed my passport at the consulate in NYC, they wanted to see how I am here legally.

Had to show visa and I-20 from school. They were OK with the student visa being expired, because I-20 was valid.

In the OP's case, hopefully the fact that they are in the process of getting GC is proof enough for legal presence.. ??

Asking for information is not the same thing as requiring it in order to obtain the benefit sought. Does anybody really think any Consulate will deny their citizen a passport based on their legal immigration status in the USA or any other country? Citizens of any country are entitled to renew their passports regardless of their status in the country where they apply.

It's the same kind of situation when a K1 visa holder is asked for the SSN when applying for a marriage license. There may be a State or two that still actually requires the SSN but the rest will accept that "I don't have and have never had an SSN" in the absence of one. By the same token, a Consulate will accept, "I don't have proof of my legal status in the Name of Country."

If the above were not true, how would you replace a stolen passport when the passport was in a purse or coat with the evidence of legal presence?

Hi

She needs to talk to Russian Embassy/consulate. Several country allow people to renew their passport no matter their status in US. Some times it is only and stamp that display the new expiration date. ( not necessarily you need a new one)

This is part of your civilian rights, you have the right to have a valid and proper identification as citizen of your country because being illegal in another country isn't a valid reason to deny your right in your native country as far as you keep your nationality.
