Timeline

Our I-864 was processed and approved in the United States. However, Rio has chosen to disregard my payments recieved as child support and denied our visa. I have only been given dead ends as far as rectifying this. NVC referred me to the Inspector Generals Office( OIG ), they in turn referred the case to a dead end office.. The bureau of Consular Affairs, which has no email, website or phone number. Any suggestions? thanks, andy

Did you provide a copy of the court order for the support AND evidence you actually receive it? How much longer does the child support continue?

NVC does not approve I-864 forms but they will reject them. Consular officers make the public charge determination.

Facts are cheap...knowing how to use them is precious...

Yes. I provided the court order. And evidence of the deposits into my accounts. The support will continue for another 13 years.

Initially K-3. But NVC changed it to CR-1 As we have only been married one year. What irks me most is the embassy staff. They were very rude. Actually telling my wife that she was ugly, and that she would end up on welfare. I think there needs to be some sort of accountability for these public servants.

The length of your marriage would impact CR1 vs IR1 but has nothing to do with K3. It was CR1, so moving on.

What exactly does the denial notice say? Since it IS CR1, I suspect you have the option of securing a joint sponsor to meet the public charge concern. I suspect there were multiple factors considered in the denial. Without knowing the exact wording of the 221g notice, it would be impossible to confidently advise you.

if you owe any money child support you will be denied

This is some of the wording but in Spanish. Please help us help you. What else did the notice say? For instance, are they returning the case to USCIS or do you have an opportunity to present additional evidence or joint sponsor?
