Going back for the CR-1 after US entry on a K-3

I was reading another topic that led me to this question.

If my husband opts to come into the US with a K-3 and go back to the UK for the CR-1 interview, how long does he need to plan to be in the UK for that? Is it as simple as going for one interview and coming home, or will he have to wait there for days or more? Since he will be living with me in the States already, can he have his medical exam for the CR-1 interview here in South Carolina?

If your husband comes to the US with the K-3 visa, he would have needed to file for the I-130 before. Once he gets into the US with the K-3 visa, he may than file for an Adjustment of Status (I-485). He would not get interviewed in the UK instead he will be interviewed in the US for I-485. He does not need to go back. Hope this helps :thumbs:

Yes it's just simple as going for his interview and once he get his CR1 visa then he's good to go back here. If he comes here on a K3 then he would have his medical done before the visa. Good luck!

Truwork is correct that he doesn't have to go back, but he may want to. Depending on how far the I-130 has progressed, the CR-1 visa can very often be a much quicker route to a green card (and therefore, may lead to a quicker route to eventual citizenship, if that's what he wants). It also may be a cheaper route to a green card, depending on what fees have already been paid, and how much the plane ticket costs. Or at least, if he was wanting to fly home anyway to visit family and friends, it may not be much more expensive.

Unfortunately, I don't know the exact details of medical exams and whether a K-3 exam can be used (our I-129F was processed LONG after the CR-1, so we never got to get a K-3), but the CR-1 interview was short and we had the visa in hand the next day. Individual cases will vary, of course.

We are filing an I-129F once we get our NOA1 from the I-130, and we plan to let both processes run to completion. He will enter the US on the K-3 so we can be together (provided it does indeed come through first!), and then go back for the CR-1 interview to avoid the pains associated with the AOS process. My questions above are meant to help us make some decisions for the future, such as whether I will accompany him for the CR-1 interview. We have to get a rough budget together for the year that lies ahead, both for time off my job and for $$ needed, since we are arranging for me to fly to the UK every two months until he can join me here in the States. Alas, big bucks take big planning!

So anyway, my original questions stand. Sorry I didn't give enough information.

Hiya Jen! Right, you are in the same boat as Ian and I with the only difference being that I am here in the UK with him and am staying with him until he gets his visa whichever comes first. If he gets the K-3 first, then he too will be flying back the UK for his CR-1 interview. Now, to answer the medical question, I believe that since he will have had one already for the K-3, that one should still hold up for the CR-1. If not, I am almost positive that having one in the States will be ok, but you have to make sure that it is a doctor that is approved for the immigration. I do believe that the medical exam for the London US embassy is near by to where you have the interview so perhaps he could look at killing two birds with one stone if he can't have the medical in the States. As for the latter part of your question in regards to how long it takes after the interview, I do believe it is all down to the post and how you have it sent to you. I would give at least a weeks time for your hubby to have his visa delivered to him. You can always change the date of the return ticket if you get the right one. I do believe there will be a fee to do such, but is minimal compared to having to pay for a whole new ticket.

Hey there, I don't know if in the UK you get the visa right after the interview or not.

If you do he just needs to go to the interview and that's it. If the visa issuance takes a few days he will have to stay as long as that takes. here in Germany it takes about a week, if you have all documents together.

When he goes to the medical for his K3, have him ask for a duplicate so he can use one for K3 and one for CR1. The medical is valid for 6 months so CR1 should be done within that period. It worked for me!
