Hey everyone, I hope I can get help regarding this matter because its driving me nuts. Now I am in the process of looking for a joint sponsor because I dont have enough income to meet the requirements. Now I have two people that are willing to help me with the sponsorship with each in different situations.

the first I think is the most qualified but Im not sure yet. Now he is willing to help me and my brother in sponsoring our fiancees, and he doesnt have any dependents so its just him, Ive read that the guidelines say he must make at least 24,000 in order to qualify but he only reported 21,000 on his recent tax return, but as I read in the I864 guidelines, it says that assets can also be used to make the difference, and he has a house that is worth 300,000 and I think some other money in the bank. Now could he use that to make up the difference or no?

The second person that is willing to help has a big family though, him and 5 others that live with him. But his most recent tax return was barely enough to support 3 people, but he told me that he has 70,000 in a home equity loan and 3 buildings that he rents out that are valued at about 500,000. So would those buildings count as assets that he can use to make up the difference?

Where did you read he'd need income of $24K? 125% of the poverty guidelines for 3 people is $22,887 (except for Alaska and Hawaii). Of the two, this guys sounds like a better choice. His income is enough for himself and at least one other person. Unless he's an immediate relative of the beneficiaries, his assets would need to be worth 5X the shortage in income, which doesn't sound like a problem in his case.

If he needs to declare the home as an asset in order to qualify then he'll need an appraisal of the home's value. If he has any mortgages then the total amount owed on the mortgages will be deducted from the appraised value to determine the net value of the home. The net value, or 'equity', is what the consulate will consider the value of the asset to be.

In spite of his property, this guy doesn't sound like a good choice. He doesn't even make nearly enough to support the dependents he's already got. Cashing out any of that equity would only increase his debt burden, and it doesn't sound like he can afford to sell any of those buildings outright because he's getting income from them. This guy might be able to qualify by the numbers, but if I were a CO I wouldn't accept him.

Should K-1 fiancé(e) visa applicants use the I-864 or the I-134?

Since fiancé(e)s are nonimmigrant visa applicants, they should use the I-134. They will need to submit an I-864 to U.S. Citizenship and Immigration Services (USCIS) when they adjust status to conditional immigrant in the United States after they are married.

Do the same income requirements apply to all immigrant visa applicants even if they use the I-134?

No. The 125 percent minimum income requirement, the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

I just found this piece of information on the government travel website and it seems weird in what its saying. If what the website is saying is true, then according to that the first guy only needs to make $18,310...but I guess when she comes there will be a problem?
