Hi everyone! I am new here and I am glad I signed up- I badly need help and I need everyone's input here.

I was previously in the USA, twas' last Dec 2009 under a K1 Visa. My fiance and I wasn't able to push through with the plan to get married since

we were all waiting for family members and others were being dramatic over if we continue to get married without them they'll disown my fiance in their

family- plus his grandmother was sick to attend so we decided that maybe we need more time to gather everyone. I flew back to PH in January and now

everyone was all ready to move on--

We would like to apply for a K1 visa for the second time under-- yes under same petitioner.

But we don't know the requirements and procedures besides making sure that we have the waiver.

Do we need to send the waiver along with the 129F and other documents such as the one I previously submitted?

Do we need to pay the filing fee beforehand?

How long the procedure will be?

Thank you all in advance and I hope you will all have your inputs here that will truly help us.

I would include the waiver wording in your cover letter and be done with it .... it's better to be safe than sorry!!!

Why didn't you just have a justice of the peace wedding and sign the paperwork without telling anyone and have the ceremony later? That would have solved a lot of problems that you will now have.

According to the law when applying for the same alien a waiver is not needed, however, the USCIS has issued a memo where as it is written a "waiver" is needed. So the safe bet is simply to submit waiver language.

Yes you need to pay the I-129F fee at the time of the submission

for 'the thing you need' - is not a form.

It's a paragraph in the cover letter, requesting a waiver of the IMBRA regulation, stating a bit about your 'history' and then clearly identifying that is same beneficiary.

The petitioner requests this, not the beneficiary, and

it goes in with the I-129F packet, on initial submittal.

Hey! thank you everyone for all your responses here-- hopefully in the next two weeks we'd get the response from USCIS.

My fiance sent them the cover letter with the waiver both notarized including other documents like the I129F and birth cert, passport copy, cert of no marriage, pictures, etc..

I hope everything goes well..

ok so after about 3mos--- I finally have my interview this coming Sept 8.

Is there anyone here that filed the K1 twice with same petitioner and was approved for a visa again?

Please share some review bout' the interview bout' this kind of case.

Wow, you aren't taking this immigration thing very seriously at all, I dont feel . Your fiancée' must be a very patient man to keep shelling out the money to pay for these documents and the stresses of waiting. Who cares if you family couldnt come , its not a joke or game.

I don't mean to be harsh but a lot of people wait years to come here , and would never ruin the chance.

I think if you didn't get married the first time while you were here, you might need to reconsider marrying at all.

Wow, you aren't taking this immigration thing very seriously at all, I dont feel . Your fiancée' must be a very patient man to keep shelling out the money to pay for these documents and the stresses of waiting. Who cares if you family couldnt come , its not a joke or game.

I don't mean to be harsh but a lot of people wait years to come here , and would never ruin the chance.

I think if you didn't get married the first time while you were here, you might need to reconsider marrying at all.

To be honest, his parents think we are taking things really fast that we decided to get married that time,

even after living together for good two and a half yrs.

My fiance wouldn't mind if we get married at that time even without thier approval but it was ME

that respect his family that I didn't want any drama between me and his parents.

As much as possible, I wanna be ok with everyone and would give as much respect to anyone until

they would give as much to me I didn't think money matters when you are aiming for a

great relationship not just with your partner but for his family as well..

Can't find myself to be selfish at that time, but thank's for waking me up...

I guess I should just ignore everybody.

If two people are meant to be together..

no money, no time is wasted because fate will eventually lead them to a happy ending..

no stress on anything when it could give back a healthy relationship between eveybody else...

I'm sorry its just that now you will have a big headache and it could take a very long time now. You might not get another chance to come back, then what?

good day!!...I guess you still have a chance although somehow you can't bring back the past...btw,glad to hear that your interview date is coming...whenever you have your interview again, maybe this time it's more different that the first interview you had..you got alot of evidences already but you will really need to justify to the interviewer what has happened on your first application..Thet has a point, you missed the 1st chance...just have faith and if it's really for you, no matter how difficult it will be, it will always be meant for you...God bless on your interview and we also hope you will see the "pink" slip again!!...be blessed!! :thumbs::thumbs::thumbs:

2010-26-08 -Interview @ USEmbassy- APPROVED( Thank you Lord!)

2010-03-09 -Got my Visa in Hand!!..Yepey..Thank God!!..

2010-23-10 -Wedding @ Springfield, MO

2010-07-12 -Filed for AOS & EAD(USPS Express Mail)

2010-08-12 -USCIS received the package

2010-14-12 -Received text & email from USCIS that they accepted our AOS & EAD Application..HAPPY BDAY MARIA!!

2010-20-12 -Got our NOA1 letters in the mail for our I-485 & I-765...A wonderful Christmas gift for us!!

2011-19-01 -Received Biometrics schedule!!

2011-07-02 -Biometrics done!!..thanked God!!

2011-17-03 -AOS Interview..APPROVED!!

2011-24-03 -GREENCARD received!!..it's green indeed!!..lol..

we filed another K1 end of June 2010 and I have my interview this Sept 8, at 7am... my only worries is-- if I will be approved again,

It wasn't HER family that couldn't come. It was HIS. Sounds like the apron strings aren't completely cut in this case, but you're harassing the wrong person about that.
