Petitioner lost of employment while AOS in process

Hello

I was wondering if anyone has ever run into my current situation. On May 25th 2010, I have turn in all the paperwork for AOS. Just received notice I797 that paperwork has been received and is going through initial review. Well right after we mailed the paperwork in, my husband's employer has announced that the company has filed for Chapter 11 bankruptcy and by the end of June the company will no longer exist. The company is actually liquidating all assets and my husband is still on payroll working on inventory. He has applied for 6 to 8 jobs in the same field, no luck so far. I am worried that by the time we go to our interview he would be unemployed, what should I do? I am currently on H1B, employed, I am not too worried since my H1B is valid until 2010. However, I would like to get my GC ASAP, dang it I have been in the US for over 10 years! I have been paying so much money on tax, I should just be granted one without question! lol. I have only put his income on the financial support documents since his income is more than qualify, I did not put mine down (lazy and did not want to make it more complicated since I put down my sister and my parents on my tax return as dependents. They live in the US. my sister in school, my parents retired way too early and never worked in the US and they lived with me). Anyway, any idea? anyone?

I've thought a bit about your situation, and the thing that 'sticks out'

is that you can hand over a new I-864 package on Interview day. If you have an interview, that is.

Your USC Spouse is the primary sponser, so if he has massive negative change in income, then is time to create new I-864 package.

Suggest you tell yer USC Spouse to get a co-sponser/joint-sponser who DOES qualify, financially, to sponser you.

So have new I-864 on yer USC Spouse showing current income levels, in addition to all prior income tax data, and

another I-864 from the co-sponser / joint-sponser. Have both ready by interview day.
