Hi, I posted this in the family based visa forum, but after reading more, think it belongs here.

I married my Australian husband in CA two weeks ago. I am a US citizen in CA. He has a 5 year multiple entry visa. We had been dating for about two years, him visiting me here mostly. My son and I visited him for a month last December. He came back to visit again on Jan. 28, 2010 and got a six month B2 entry visa. While he was here, his sister in Australia almost died and underwent a Kidney transplant. He said this made him reevaluate what is important to him and that is me and he proposed. We got married on May 15, 2010.

He has been here for 4 months on a B2 visa. I am helping him do all the paperwork for adjustment of status. I have a question regarding Adv. Parole.

When filing out the form, it asks for an exact trip date and I do not have one yet. We want to go back to Australia in December to do another reception there for his family and friends. My main concern is his father is 89 years old and his sister just had a kidney transplant. Either's health could go downhill quickly and I want him to be able to fly home to visit or hopefully not, for a funeral without abandoning his adjutment of status. Is there a way to ask for the ability to leave without a specific date? What is the best strategy for him to get advance parole.

T.B.A. on the date.

If you file ASAP, by December his Green Card will already be broken in.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

Hi Bob,

Thank you for your reply. Hopefully this will all be wrapped up by December, but I still want him to be able to fly home for a visit in case of his dad or sister's health. I do not want to be the reason that he doesn't get to see a loved one before they pass. Does anyone know how to request this on the AP application as it does ask for a specific date for travel.

Any advice is much appreciated.

Warm regards,

Nancy

why did he have to pay so much for i-693. did he need a new heart too. that was way to much.

but anyway, it is done so it does not matter.

Now what you guys need to do is to apply for i485, i-131, i-130, i-756 and if he is not working here in the usa you should also fill up a i-864. (go to lawyer to help you fills these up)

if you mail all these four document by the end of june, your husband should normally received his green card in november 2010.

NB: the whole application process is easy, the things you have to prepare is the interview for green card. have joint bank account,a whole lot of picture, wedding certificate and wedding picture etc... (your lawyer will fill all the blanks for you.) things that will allowed the interviewer that you guys are real together. the uscis want to make sure that your marriage is a real bonifide wedding.

good luck :)

Hi there

I would just set a date in 2 months from the moment you submitted; I would also add a letter explaining them his sister's condition and that he might have to leave even earlier than that. I was a B2 and i receoved my advance parole in less than 2 months. Good luck and ... all the best to your and his family.
