yes i totally agree with that one, i have alsoa friend of mine whos hubby from egypt and they have a big age diffferent ,,,, and not onlhy were they approved buyt visa recieved in a weeek, but always be positive and find out egy lover exactlyyyy what thier grounds for denial was, age difference is not a technal word for denial,, so find out what it is and u may also check into a lawyer good luck!

all the interview sister was about age gap she didnt talk about any other thing

just one more point i dont have any other red flag just the age gap i was have around 200 pic in album and like 200 page of phone bills for the whole last year and tickets recipt snail mails air tickets resturants recipt every thing and when i told her can u see she said i know u have every thing any way iam just wait the letter she called the senator and we gona sue them

I'm not sure about the embassy calling you for an interview before the NVC had completed processing, I'm not sure how many consulates/embassies have 100% gone to NVC scheduleiung the interview for an immigrant visa petition.

However, there is something you need to understand. You have not been officially denied. The Department of state (consulates/embassies) do not have the legal right to officially deny a petition. The only thing the embassy can do is refuse to issue the visa at the time of interview, return your petition and application to the USCIS office who origanlly approved the petition, along with a request to review and recommendation to revoke. Only the USCIS can officially deny this petition. Also, the CR1/IR1 approval never expires, so action on this petition must be taken with this petition.

With that said, the USCIS will do one of two things:

1. Review the returned petition/application and determine there were no grounds for it to be returned in the first place. In this case, the peition approval is reaffirmed by the USCIS, everything is sent directly to the NVC for a new interview to be scheduled with the embassy in Egypt.

2. Review the returned petition/application and determine there were or may have been grounds to return the petition. In this case the USCIS will send the petitioner a NOIR/NOID (notice of intent to revoke/notice of intent to deny) and give the petitioner a specific timeframe to rebut the consular findings. If the rebuttal is successful, the USCIS will reaffirm the petition approval, and send everyything including rebuttal and supporting documents directly to the NVC to schedule an interview with the embassy in Egypt.

The reason you gave for the return is very generic, and something we have faced in the Moroccan consulate...for validity of relationship. This type of reason for return is one of the most flimsy reasons as they indicate the CO was merely going off of personal doubts they may have about this specific case. You should know that unless you have a real visa ineligibility such as criminal, medical, fraud or misrepresentation, you will eventually get your visa.

The return process can take anywhere from 6-18 months, depending on work load of the USCIS center who approved the petition, but since this is an immigrant visa petition it will get reviewed.

Unfortunately you aren't going to be able to sue the US government for this. Believe me, I know personally how you feel, when this happened to us I was ready to fight them with every penny I had. They eventually issued my husband's visa because there was no real ineligibility, we just had to go through their steps to get it.

It is very unfortunate that there is this clash between the Department of Homeland Security and the Deaprtment of State when it comes to visa refusals, and we are the ones who pay the price.

There is a process for this however, and you can make it through to be reunited in this country. It will take patience and perseverance. But if you both love each other and are willing to go through the return process, you can make it together.

Just prepare yourselves for when the NOIR/NOID comes, be ready to rebut anything the consular officer raised as an issue such as any red-flags you might have.

i was sure from this before the interview but u not gona belive it until u see whats going on iam not the only one its like 4 case this week and the problem is the age diffrence and they ask like they Irony i belive its just the age diffrence all the interview was about it i dont have any other red flags

Now I am curious Egypt Lover. What is the Age Difference between you and your wife? And also the age difference of those other 4 that you said were also denied visa due to age difference? :innocent: Also is the husband or the wife younger/older? Having said that, if you still claim that the age difference is the ONLY reason they denied your visa and that EVERYTHING else can be backed up by some irrefutable evidences, then by all means, GO AHAED and SUE the hell out of that consualte. :yes: But again, you must be honest and clear that the AGE DIFFERECE between you and your wife is the ONLY and ONLY reason for the denial. :unsure:

listen the age adifference could in facgt play a difference but u applied for a visa previous to this one also, and yes ppl have had visa denied befor and yes there was an age difference but normally its age difference plus something else, i do know ppl with hugeeeeeeeee age differences that got the visa and why?? because they made multiple trips to egypt, been together for years, lived in egypt ,, had lots of evidence,, plus many facgtors,,, so the key is if theres anyyyyyyyy red flags u must totaally prepare for them and show alll you have that u are a bonifide marriage, it can be a combination of thinhgs, lets say big age difference plus 1 trip to egypt, knew each other 1 month th iten asked to marry then came there to marry and stayed 1 week only,,, then a mlonth later applied for visa,,it can also be big age difference,, flew to egypt 3 times, been together 2 years but,, family dont approve and the english not good,,its a look at the big whole situation, i know cairo embassy is tough my brother and i feel for you and i still say get a lawyer and fight for your right to be with ur wife :thumbs: but do keep in mind, cairo does in fact like many embassys sees thier citizens getting used for the visa and are doing thier best to cut down on these crimes, i know they can be tough and arrangant and i rant about them also, but the bottom line is this,, you love her and she loves you so get a lawyer and go back in with both fist swinging hehe just figure of speech :blush::whistle:

I'm so sorry bro to hear about what you went through .Well as most of people here told you the age gap is not a big deal '' I have seen so many people with huge age gap and they got their visas '' .But it seems like it depends on the CO mood .Maybe the same CO will approve a couple with huge age gap and maybe the same CO will deny another couple cause of age gap!!!

Talking about sue them .Believe me it wont worth it bro .It will cost you a lot of money and it will take so long time .

Try to get your wife's senator involved .They might give you another interview .

Keep in mind, this decision of denial is not end of the world, its a big world out there, Yes fight the decision, but still remember, its not the end of your marriage to her, keep planning on a life together, and look at new options also of making a life together. Well from my experience with Texas Senators, their offices worked fast for me, I heard from them within 24 hours when I contacted them for help.

Just give a bit of time , all answers will come. God be with you both.

Emailing or faxing is truly the only way, unless your wife goes to the office of the senator. If she goes, have her bring all paperwork pertaining to the immigration paperwork!!!
