This is not your question, but, I see an issue in income for 2009. the co-sponsor only earns 13k, and you have household size of 4+ children..... isn't 13k below the poverty guidelines.. this may bring up many questions.

Your sponsor and co-sponsor combined don't make enough money for two people, let alone the kids, unless you misstyped their 2009 income and/ or their current income is much higher than in 2009. You will need to find another co-sponsor.

Correct. By my reading, the co-sponsor (actually "joint sponsor")doesn't come close to qualifying. You need a sponsor with current income that qualifies them based on their own household size plus any intending immigrants they are sponsoring. While three years of income information is asked for on the I-864, it is the current income (which may or may not be similar to the 2009 income) that rules the day.

I have my own dilemma!! hope you can help me out.

I will be sponsoring my husband, I have two kids so it will be a household of 4 @ 125% of poverty line is $27, 562

  • 2009 taxes 24,625.00-- (I'm short 2,927)
  • Child support 16,000 which brings my total income to $40,625.00

I have a court order that specifies the amount and it will be in place until my children are done with college another 3 years for son and then only for daughter 5 more years.

My ex deposits by check to my account.

I'm also co- owner of the house I live in with my kids, I will use this if I have to (mind you I do not pay the morgage court ordered as well in my divorce agreement)

I think this should be enough I do not want to use a sponsor, I have two people willing, I just want to do this on my own. Can you give me your input please? much appreciated!

Emily

Then you state your current total income and document the child support both with the court order and a few bank statements showing it actually gets paid.
