I didn't know where to post and since this happened in China I just went with that. The explanation on what he would have to file to marry her helped me understand. I have a copy of their marriage license in China. He hid it under the mattress in the spare bedroom. Very original or he thought I was very stupid. Signed by both of them and is entered into my divorce documents. I did see a bogus application for immigration and he had us divorced in 96 and had me living in a different state. That is also in my divorce documents. He also told her the alimony going into my acct. was for farm maintenance on "their" farm. So she has been trying to see what the money has been spent for. Again his fault for lying to her but is causing me some problems. Could you point me where I need to be. I am my only employee and by the end of a very long day I am tired. Six horses on here bringing in money to try to cover what the ex is not sending me. All older and needing special attention makes for a very long day.

While it appears this forum has been of some use to you, I would say that if your problem is an ex husband not paying alimony, the place you need to be is your attorney's office. There is no Visa Journey forum dealing with collecting alimony. You want him to work and pay you and you don't want him in jail for immigration fraud or bigamy where he couldn't work and pay, so it would appear there's no need for immigration related assistance.

hey Rembrandt - thanks for the backgrounder info.

I can understand a bit, about yer situation, now.

The thing that I see, that will impact the THREE of you, is that 'co-mingling of funds' -

--you probably had a joint account with the ex, and it's probably still set up on both names. You can go to the bank with divorce decree, and get his name off of the joint account. He might argue that it's easier for him to make deposits into it, with his name still on the account, but that's BS - he can set up electronic payments from his 'other account' into yours, is simple ach transaction from his bank account to your bank account.

--if you two had joint property, it's time to get his name OFF of the deed and any mortgage. She may be seeing such a property as a 'seizable asset' . If mortgage payment (by him to you) process is tied to any existing court order or decree, you can get it modified to be paid another way.

--if you two have any joint credit cards - it's time for one of you to be off the accounts. You will only know who is the 'first account holder' on each account, so you might 'lose out' on some accounts, 'gain' on others. It may be she is studying HIS assets, and wants (rightly or wrongly ) to be added to his accounts. That, in itself, is a normal thing, but usually a USC spouse 'divulges all' to his new spouse. If she's trying to get added to your current joint accounts with him - I think you can see the problem, ah ?

Caveat - I'm not a lawyer, and I don't play one on TV. Many of these issues for the un-co-mingling of funds you can handle yourself, directly, but must 'go in person' on most things, rare to handle name removal over the phone .

I think what you've described is a clear case of fraudulent marriage with her, fraudulent divorce with you, and because of THAT fraud, the immigration process (for her) was fraudulent as well. There is some regulation that the USC must be 'free and clear to marry' prior to actually getting married to a foreign spouse - and that didn't happen with yer ex-husband.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

No, what you get from a Chinese Consulate is a certification of an "Affidavit of Single Status". There's not telling which he got but one or the other was obtained fraudulently.

Agree with you Mike. I got mine out of the Houston Chinese Consulate.

Sorry if I led anyone to believe that document is associated with the USG.
