I know someone who immigrated a Chinese woman into the states as his wife. I don't want to get anyone in trouble just wondering how he managed to do this. How close is he checked as her sponsor? He married her in China in 2006 and divorced his American wife in 2007. How did he manage to do this? His wife still shows up on credit checks and they still have a mortgage together. I thought immigration checked applications more closely after 9-11.

I think what mattered more, was his 'prior divorce status' on interview day. As well as 'when' the interview day was.

IF HE NEVER reported the divorce, and got an affadavit of single status at a US Consulate/Embassy in China and NOT mention the prior wife, then he did something wrong....

MAYBE he was actually divorced on interview day, but ....

did she come over on K-1 or CR-1 ? in 2006, CR-1's were taking forever, records took forever to finish on the 'namechecks' and 'background checks'.

Yer friend is lucky, so far. Do you know which greencard she currently holds? (2 yr or 10 yr? )

I think what mattered more, was his 'prior divorce status' on interview day. As well as 'when' the interview day was.

IF HE NEVER reported the divorce, and got an affadavit of single status at a US Consulate/Embassy in China and NOT mention the prior wife, then he did something wrong....

MAYBE he was actually divorced on interview day, but ....

did she come over on K-1 or CR-1 ? in 2006, CR-1's were taking forever, records took forever to finish on the 'namechecks' and 'background checks'.

Status on the marriage date and petition filing dates are critical, not on interview date. 2006 wasn't all that slow actually at least for a K3 which is what most people did back then. Moot point as you must be free to marry to file for a fiancee or free to marry to have a legal marriage in China. If he didn't divorce until after the marriage in China or after he filed the petition, he committed fraud.

Yup - agree on the fraud bits.

I think is other name for this, as well - something about misrepresentation, something else about bigamy, something about lying on an application to a federal entity (fraud's included, but is some other name for it).

Yup - agree on the fraud bits.

I think is other name for this, as well - something about misrepresentation, something else about bigamy, something about lying on an application to a federal entity (fraud's included, but is some other name for it).

Sure, fraud via "material misrepresentation" resulting in deportation if applicable and lifetime ban for the foreigner and potential criminal prosecution and prison for the US Citizen. Another term might be two words starting with D and S.

Bob - ya, is verra messy, IMO -

Can get that 'affadavit of Single' from US Embassy - so I think he lied to a US Vice-Consul in China, first, to get that document.

Then had that affadavit translated into Chinese, affadavit accepted by the Marriage Bureau Office where he was married.

To the best of my knowledge, a 'Certificate of Marriageability' is never issued to a USC, from any Chinese Office.

No, what you get from a Chinese Consulate is a certification of an "Affidavit of Single Status". There's not telling which he got but one or the other was obtained fraudulently.

He married her in Feb. 2005 in china. He worked overseas. Wiped any info about his American wife from his work records. She divorced him in 2007 and he got the Chinese wife into the states on christmas day 2008. The Chinese woman didn't know what he had done. Not her fault. And Yes, I am the ex wife and they are causing me a lot of trouble

Then you've been divorced from this man since 2007. What's the trouble for you? It certainly isn't immigration related. This is an immigration forum. Your ex husband is a bigamist who committed immigration fraud. How does that impact you?

Then you've been divorced from this man since 2007. What's the trouble for you? It certainly isn't immigration related. This is an immigration forum. Your ex husband is a bigamist who committed immigration fraud. How does that impact you?

When I run across something that doesn't seem right I like to know how things work. How the immirgration process works and how he managed to slip thru the cracks. Because his new wife doesn't know the truth she has been causing me some personal problems at the bank and on the mortgage acct. that still has the ex's name on it. We are still

tied up financially and now I need him to keep working as he owes me money. I had to get contempt charges against him for not paying my alimony.

She has been trying to get into my bank accts. It's just a real mess and I just wanted to know how he got away with this mess. If I'm in the wrong I do apologize. I understand that he has lied to eveyone and that is how he did it. The financial fall out form this could cost me everything I worked for over 33 years just because he lied to everyone. If filing contempt charges might bring up what he's done I need to find a way around this mess for myself.

Just the replies I have gotten on this has helped me realize how he lied and that I need to get untangled from him financially. Thanks and I won't write again if I don't belong here.

You are perfectly fine to be posting here. The poster that responded most rudely is like that all the time. Don't take it personally.

How is she attempting to access your accounts? That's fraud and I'd have her charged with attempted fraud for trying to access your accounts if I were you.

Regarding immigration, call ICE at the bottom of the page and report the fraud. You'll probably need his SSN and their address if you have it for starters. Let them know that you found out that PRIOR to your divorce in 2007 that your husband married his immigrant wife in another country and applied to have he bought over using a fake marriage certificate. Now the issue here would be that do you have PROOF that they were married before you were legally divorced? You might not need it as the marriage certificate will be in their immigration file... it's weird that he was able to do it because he would need to have show his divorce from YOU before he was able to bring her over. unless he never disclosed he was ever married...

I don't know what you can do about the bank stuff but I would speak to a lawyer about it. Let them know what he's doing and find out what you can do to have him removed from your mortgage (whether he takes out another bank loan in order to pay off his half of the mortgage or whatever).

**Edit - I respect you for trying to do what right as I am the same. I hate this whole "its not my business" attitude that people have. People should NOT be allowed to break the law. People shouldn't just stand by while others are abusive to animals, or attacking someone for fear of what it would do to them. I've always told me family I would rather die or be seriously injured trying to HELP someone than live with the incredible shame of doing nothing simply to protect myself or "not be involved". Being any other way is shameful.

Nobody suggested you don't belong here or shouldn't post. Questions were asked. You answered them quite well. You HAVE been a bit deceptive though. You are not Chinese and have no Chinese spouse. The profile you set up and how you set it up gave the impression you were involved in an immigration process where either the petitioner or beneficiary is Chinese. Perhaps the deception was unintentional. Either way, we now understand who you are and the context of your questions. It helps us answer more reliably.

Your questions do not actually relate to China though so there may well be a better choice of forum to ask your non Chinese and non immigration related questions. "Better" in that you'll get the kind of assistance you seek instead of what you don't need.

I didn't know where to post and since this happened in China I just went with that. The explanation on what he would have to file to marry her helped me understand. I have a copy of their marriage license in China. He hid it under the mattress in the spare bedroom. Very original or he thought I was very stupid. Signed by both of them and is entered into my divorce documents. I did see a bogus application for immigration and he had us divorced in 96 and had me living in a different state. That is also in my divorce documents. He also told her the alimony going into my acct. was for farm maintenance on "their" farm. So she has been trying to see what the money has been spent for. Again his fault for lying to her but is causing me some problems. Could you point me where I need to be. I am my only employee and by the end of a very long day I am tired. Six horses on here bringing in money to try to cover what the ex is not sending me. All older and needing special attention makes for a very long day.
