While it may be for better or worse the court of appeals for the Hollywood circuit it covers a large area including rural states such as Idaho, Alaska & Montana. It sounds like what the court held was more about the safety issue having to do with the roads. I'm confused by the article though because it seems it's mixing the definition of day laborers and transients. Maybe they combine them all in a certain poverty line and lifestyle?

Even in our capitol city, Boise, we don't see this much here because it's too cold for them most of the time. They aren't working the traffic cleaning windows or selling things. Sometimes we get deaf people selling pencils in parking lots. This group of day labors/transients start appearing in the late spring and summer and then move on somewhere else.

The last 3 years though I've observed several community outreach shelters open in the downtown area and more people asking for money on the busy street corners. They aren't looking for work as much as they want money for alcohol or drugs or whatever. I've tried giving them food and they throw it at me or ask for money instead so I stopped helping them. Then I've over heard young street people talk about how they make more money standing at a store all day with a sign then having a regular job. Last Saturday at Farmer's Market there was a transient without a sign holding an imaginary sign up so people would get the idea anyways. One time I found one passed out spread eagle in a parking lot in a puddle of his own puke in broad daylight. I wasn't sure if he was dead so I went over to check on him and gave his shoulder a nudge. He opened his eyes and I asked if he was alright and he said he was just sleeping.
