I have a friend who is here on a two year multiple entry B2 visa but currently changed his status to H1b. He now needs to go back to his home country for a short visit. Here is a little background. He was initially here on an F1 visa and adjusted to H1b, worked for almost 1 1/2 years and then left the country for about one year. He just returned on the B2 last October. Now the question is will he run into problems returning as the B2 stamp date expired end of February.

He claims the old H1b stamp is still valid and won't need to get a new stamp even though he has changed companies and works in a different state.

Thanks

The fact that he now works (and I assume, lives) in a different state could cause him some issues. A lot of immigrants run into unfortunate issues when multiple visas overlap. I would tell him to talk to a lawyer before he attempts entry/departure, just so he can head off any possible issues that may pop-up at that time. Better to be prepared, than have a terrible time trying to leave/re-enter the country.

Sounds like he will have an interesting reception.

Your friend changed his workplace, so definitely that H1B status is not valid anymore. I would say at this point he is out of status. Of course, I am not an immigration lawyer. Better to double check.
