I'm filling out the I-864 for my spouse (the intended immigrant), but because I have no income, we have to use his income as proof.

So does that mean I fill out the I-864 and he fills out the I-864a? or does he not have to fill one out since he's the immigrant...?

Will his income continue in the United States and if so, can you prove it? If not, you cannot use him and will have to find a sponsor in the United States, using the I 864. You can also use assets, but they have to be 3 times the required income.

yea he works in ny right now. his employer wrote him a letter stating his permanent, full-time position and states his annual salary.

It would help to know exactly what you guys are applying for. You will need to fill out the I 864, even though you have no income. On line 24, part b of the 864 you can use income from members of your household-I assume that you are part of the same household and then combine yours and his. I believe that you would then check box e without the need to fill out a I864A, but I would double check that (it would be nice if someone else responded, but you can call). Send in his W2s to make sure that they know that he has a job in New York and write it in a cover letter.
