I have a two year old that recieves disability because one she was born 16 weeks preemie and two she developed cerebral palsy. This will not change or get better she will have it her whole life. Is this going to affect my petition for visa when I finally file for him to come over? I am so worried and want to have my ducks in a row before I start anything. It is all so confusing. Thanks so much to who ever helps.

As a new immigrant your child will need medical coverage. Medical care in the US can be EXTREMELY expensive. You will have to show that you can provide whatever medical care your child needs without the help of public benefits. You don't state what kind of issues are involved but you may find the costs of this prohibitive.

This will not be over quickly. You will not enjoy this.

Just because your daughter receives SSI shouldn't be something that affects your visa.

I would think that is something that you wouldn't have to put down as income considering it's for the care of your child, but then I'm not an expert on the subject.blush.gif

Forgive me if any of the following does not exactly describe your situation, but you gave practically no information about your immigration case, so I had to guess. :blush:

It will not affect your petition in any way. It may affect your eligibility to sponsor your fiance/husband with an affidavit of support. The SSI cannot be considered as qualifying income because it is a means tested benefit that is funded by US taxpayers. The whole purpose of the affidavit of support is to ensure that the immigrant will not be supported by public funds, so public funds you are already receiving can't be considered in determining if you qualify.

If you have sufficient income OTHER than SSI, then you can qualify to sponsor him alone. If there are only three of you - yourself, your daughter, and your fiance/husband, then you'll need income of just under $23,000 per year (again, your SSI cannot be considered). If you don't have sufficient income, then you'll need to get a co-sponsor who does.

Yes sorry, I am in the usa, my fiance is in Egypt. She is the youngest of my 4 children. So you see he will have his hands full just to be with me. I just wanted to make sure that her receiving the ssi would not affect the process of his visa. We have yet to start the process because we want to be completely sure of what we need to do before we file. Oh and the fact that we have yet to get married. We will be filing a cr1 when we finally do start the process. I am glad that there is a place such as this to get information about this stressful transition. Does anyone know if child support is included in the income allowed or not because I receive about $500 for child support for the other children from their father. The baby, however, doesn't receive anything from her father because he dipped out on us before she was born. A completely different story. Anyway, thanks for all who responded.

Ok, the details are a little different but the net result is the same - the SSI won't affect the visa process, but the SSI won't be considered as qualifying income for the affidavit of support. Assuming your fiance isn't bringing kids of his own, and you don't have any other dependents you haven't mentioned yet, then your household size will be 6; you, your fiance/husband, and your 4 kids. You'll need income of $36,912. You can use child support payments to help you qualify.
