Hi Darnell,

I need your help, I failed the visa interview at GUZ consulate on 4/1/10 and I've sumitted all the papers they need at the end of April, I called the DOS today and the person told me that the case is ongoing, under processing of review, still pending, In your opinion, when they will make the dicision?

If it's undergoing review, it's not denied. Not yet. You're in AP (Administrative Processing/Administrative Review).

What were the questions asked? How did you respond to them? What do you mean, "you failed the interview?"

Were you issued a 221g? Any other information/documentation requested from you?

What were the questions asked? How did you respond to them? What do you mean, "you failed the interview?"

Were you issued a 221g? Any other information/documentation requested from you?

I mean my visa is refused and they requested additional information from me, I've submitted all the information on the blue refusal sheet, and now the status of the case is pending, so I would like to know about when they will make the dicision.

1st, you've received a notice of refusal not a denial. This is very common. On the 221g there should be a date that you were required to submit the additional information required. Typically you must wait 60 days after that date to make inquiries.

So you have not failed, you just not have passed. You are in AP limbo. Unfortunatley I don't think anyone can tell you how long this will take.

We received a 221g after we received approval! Actually got the 221g on the day we returned to receive the visa. It took is two weeks (but in our case it was not a request for more information - it was a technical problem with the readability of fingerprints that had to be resubmitted).

If you post exactly what it says in the 221g it might provide some additional insight.

ok - you got a blue slip - this is an 'RFE' in GUZ speak, and a 221(g) for the rest of the world.

Relax a bit - let me think on this.

If I understand you - it's been about 6 weeks since you submitted the 'overcome evidence'.

Rarely, is within 3 weeks to review and issue the visa.

USUALLY, is within 3 to 4 months.

If something gnarly, like DNA evidence on PRC child, can take 3 months to one year.

I'll post a bit more, later.

Was this for congenital heart disease --> http://www.visajourney.com/forums/topic/244039-medical-exam-issue-pls-help/page__p__3829796entry3829796 ???? IF SO, I have NO IDEA - it's up to the VO to grant a medical waiver - but IMO, a waiver will be granted, will be special coding in the VISA STAMP.

Some q's for you:

1. Did they keep yer passport , or not ?

2. Exactly what did GUZ IV ask for, in the blue slip ? Give me exact verbiage, exact wording, on the things that were:

--ticked in a box and

--handwritten in

3. were you given any call-in letter, or not ?

FWIW - you weren't 'denied', at all. Visa not granted that day, and that's still OK. You had opportunity to submit that evidence, and you submitted it - so they still have to :

--work it through the queue of those waiting for 'further review', prior to your case

--evaluate the evidence

--make new decision

Most blue slips at GUZ IV, take 3 to 4 months, from submittal to 'call-in letter' issued. If they kept yer passport, then you won't have a call-in letter - instead you will ONLY KNOW when it was mailed out, by checking with the DOS Hotline Human (# in my profile).

My apologies for not catching this earlier -

Remember - I BEGGED YOU to 'home yer account to China' a few months ago - and ya dinna do it. I would have 'caught this' earlier in the day, had you 'homed yer account to China'. BadBadBadChinaGirl - do I ask for 300 venison jiaozi now ?

PS - was this an IR-5 for a parent? or something else ? CR-1/IR-1 etc etc...

My case is F-3, (1) they didn't keep my passport,(2) there is no ticked on any box on the blue slip, but was written as "please provide the statement how the petitioner plan to pay for the care and the treatment" (3) I sumitted the evidence on 4/22/10. I called the DOS today and have been told the case is ongoing and under review processing.

OK - I think 3 to 4 months on turn-around time.

You'll be sent a 'call in letter' via postal mail.

Then bring that letter to GUZ IV with your passport, and then 1 to 2 weeks later you'll receive the passport back, with the visa in it, plus a huge sealed envelope.

Call In Letters are similar to appointment letters, in that the Guard lets you inside the Consulate - but usually, is not any 'set appointment' - is just certain days of the week, certain times, that you can come in.

Good Luck ! I suggest calling DOS Hotline once a week, and emailing GUZ IV unit every two weeks, inquiring for status.

WHO KNOWS? A miracle might occur, all gets done by Friday.... I like to be optimistic, but that 3 to 4 month window seems to be 'the norm'.

It's really hard for me to say -

as there haven't been cases posted here on VJ for China,

that have this medical waiver and subsequent financial proof required.

I wish I had other info for you, but for this, the bucket is empty.
