Let’s go over some facts here….

Most of the March petitions were transferred to CSC on 6/1 and CSC acknowledged their receipt of them on 6/14. I mailed mine in to NSC on 5/30 and was promptly transferred to CSC. CSC acknowledged receipt of my petition on 6/9.

Do you suppose any adjudication was done on the March petitions prior to the transfer? Highly unlikely…

That being said and if the theory of adjudication being done according to IMBRA RFE received date is true, then why have I not received an approval yet? It makes absolutely no sense at all.

Theoretically, mine should have been approved in the first batch of approvals being issued in late July. Does this not make sense???

Most of the late May applicants have similar timelines with regards to early transfers to CSC and many were approved on 7/31 if not before….

Unfortunately, the NOA-1 date is irrelevant at this point.

May and June approvals are falling from the woodwork.

It appears to follow RFE return dates instead. You should be approved at any time.

I'm a late May applicant....

See the following timeline as proof of what I am saying...

05/15/2006 - sent to Texas Serv Center

TSC transfered file to CSC

05/30/2006 - received NOA1 from CSC

06/28/2006- RFE received in the mail

06/29/2006- RFE was sent back

07/08/2006- UPDATED !! csc received RFE (IMBRA)

07/11/2006 - touched

07/21/2006 - received an email -- CASE APPROVED !!!! WOOOOOO HOOOOOOO

07/22/2006 - last touched by CSC ( same messege, case approved on blah blah )

07/28/2006 - Received I-797 Notice in the mail ( Case Approved) forwarded to NVC !!!!

Called NVC, they received mah case on 07/27/2006 and provided me with a new CASE NUMBER YAYY !!!

08/02/2006 left from NVC to the Consulate in INDIA

08/02/2006 - Received by Consulate

08/04/2006 - Mailed Packet 3 to fiance

WAITING FOR THE INTERVIEW NOW !!!

Theoretically, William and I should have received our IMBRA RFES in the first batch in June. Then we would have been in the first batch of approvals.

Theory has nothing to do with it at this point. There is no rhyme or reason, no logic, no justice and no explanation. I'm sorry I have can offer no help to you as I am a MARCH applicant and I am still waiting.

According to my congressman, right wrong or indifferent that is exactly what is happening. They are using the RFE receipt date as their priority date.

Now what is really wrong with what has happened, is that they did not send out the RFEs in order of NOA1 dates. I dont know of anyone who has been able to answer how they determined the order of priority on that one. Even my congressman did not have answer for that.

Even when they were going strictly by NOA1 dates, it didnt mean that because your NOA1 was earlier than someone else that you would be approved first. However it did mean that rarely would someone be approved 3 months ahead of the rest of the crowd.

Believe me I know how frustrating this whole mess is, just got our NOA2 this weekend and we were with the first batch of RFEs.

If it is any consolation, my congressman is still waiting an answer as to why the RFEs were sent out the way they were. If and when I get an answer I will pass it on to you all.

Just when I had started adjusting to the RFE processing date, I now am starting to see people with much later RFE received dates getting approved before people - like you Gary - with earlier received dates. Not that I begrudge anyone an approval! I just thought I was seeing some semblance of order there for a second. ~sigh~

04/13/06 - I-129F mailed

04/18/06 - NOA1

08/30/06 - NOA2

09/26/06 - received at NVC

09/27/06 - forwarded to consulate

20/11/06 - visa in my pocket!

14/01/07 - POE

13/04/07 - marriage

27/04/07 docs sent in for AOS, EAD, AP

26/06/07 - biometrics appointment

02/17/07 - AP and EAD arrive

03/03/08 - Infopass - where the heck is my AOS interview?? No one knows!
