is there anyone had this problem before?

okay here is the story

Im already in US and my husband wanted to put me in his insurance. Ive got my social security number last week. So my husband went to his HR to ask to put my name in his insurance. They said that He should put my name 30 days after married but my hubby said he cant bec im not here yet.... which is right.. so they said AGAIN we have to wait till december to open enrollment and ofcourse my hubby said NO he cant..its a long waste to wait.. there is so many things can be happen within 6 months....so then they asked my hubby if im already a US citizen, and he said not yet just a temporary citizen but after 2 yrs YES i will be... and then they asked for documents saying that im legally resident here.. So i gave my visa and my SSN... but still they are not happy with that.. so my hubby went to Union and the Union said we have to wait after 2 yrs so that im already a US citizen! what the !!!!!!!!!!!!!!

Im really pissed! they got my SSN so now what????????????????????? I talked to people how they put their spouse in their insurance and they said just get a form and give a SSN..which we did but his company is sooo greedy and stupid!

can somebody help me pls!

your story is quiet confusing...do you mean to say that your husband first wanted to out you in his insurance when you were not here in the US yet? and he was told it should have been 30 days after you got married? and now that you're here and have your ssn you're asked for proof of residence?

did you show them your gc as proof of legal residence? :)

What? Unheard of. You guys are married, right? HC It has NOTHING to do with citizenship as long as you are a legal alien.

Here's what I did. I came on a k1 on 03/03 and had a travel health insurance until the end of March, after that I have been on my husband's insurance as of 04/13. My hubby called his HR and they say to contact the benefit center, which he did. They told us I could be added as early as the first day after our wedding. We needed to send a copy of our marriage certificate, and they wanted my SSN, address and date of birth. They also told my hubby that since his status had changed to married, he was eleigible to change/upgrade his plan, which we did because I needed some dental work. It took a while to be added, maybe 4 weeks, but that was because their system was down and they messed some info up.

You need to talk to a supervisor and cut the BS ;) you guys are legally married and usually you don't have to wait for open enrollment to be added. What insurance company is this? Maybe try to research online to see what their policy is about adding dependants...or call their customer service (without going through your husband's company.

What kind of position does your husband have in the company? Does he have a full time job or a part time, or is he a temp? That MIGHT change the situation, but I doubt it. Seems to me you are speaking with incompetent people... Keep us posted and good luck!

You need to remember that insurance policies are legal contracts and whatever the terms of that contract are govern acceptance of spouses as additional insured. The laws in each state vary. We are in a similar situation in that my insurer requires the insured to be in the USA for 12 consecutive months before they will add them to an existing policy. I purchased temporary health insurance to cover her for that period. Read the policy and see what it says. If the company is violating the policy you can file a complaint with your state insurance commission.

ok. he went to HR and he told them that he wanted to put my name in his insurance but the first thing they said was he should do that 30 days after married but i wasnt here yet so it cant be possible and then the second thing was we have to wait till december ,3rd thing was show a proof of residence, so my hubby gave my SSN, my visa. i dont have my GC yet but they dont need it. the only thing they need is the SSN... So just today they told my hubby to wait after 2 yrs! Im lost!

Sorry but the Health Insurance Company isn't stupid or even wrong in this case.

To add someone to Health (Medical) Insurance you need to have a qualifying event. You then have 30 days from that qualifying even to add them. Here is a list of Qualifying Events:

1. Birth

2. Marriage

3. Loss of Other Coverage

4. Open Enrollment

5. New Hire

Immigrating to the US or even obtaining any kind of immigration status is not a qualifying event.

Your husband could have added you after your marriage even with you residing out of the country but any benefit you are entitled to in another country would be minimal.

When we married I choose to not add Anna & Gabby to my insurance as we didn't know when they would be coming to the US. Once we made it to the NVC stage I decided to add them at the next Open Enrollment period which was October. They arrived at the end of November and had coverage!

I had a problem with our insurance with my work too at first.

I called to inquire the same thing once I gotten married to my husband. They told me to wait until open enrollments since he was not in the US at the time. I did, they started to deduct the payments out of my paycheck the beginning of the year. For some reason they audited my insurance policy and found out that he was on my insurance but not in the US yet. So, long story short, I was reimbursed the payments that were deducted out and once he came into the US we had to send in the visa stamp with the date of entry on there and they reactivated his insurance from time of entrance.

He should definitely call his benefits department and talk to an actual supervisor. I had to go through several people before I got an answer.

I hope you get it straightened out soon!

The company isn't stupid. This is the norm in most companies. Important life event changes are to be registered with HR within 30 days. The company allows 30 days to add your dependent to the insurance or else you must wait until the open enrollment season. Your husband could've added you to his health plan even if you were outside the US. He'd be paying the health premium without you actually getting any benefit. I'm sure whatever country you came from doesn't accept American insurance companies.

You're new to America and you're already whinning about American ways of life. Sheesh.

Rian? If you can get a letter from where you were covered under insurance in PI, they should accept that as proof of loss of coverage. That is what I was told would be needed to add my husband outside of open enrollment.

FYI - You don't have to have a social security number to be added. My husband doesn't have one yet, and I added him (we weren't sure we could get a letter stating he lost coverage from moving here) in open enrollment back in November. When they sent the letter asking for the social, I called and explained the situation. He is covered (not very well, thankfully he still has coverage in Canada!), and has been since Jan 1.

I can’t believe his insurance denied you. My insurance had no problem adding my wife to my policy even when she was still in the Philippines. They have no problems reimbursing me the cost of her medical treatment. All you should need is proof of marriage like your marriage certificate. I would really pressure your insurance company to add you.

From the way the OP is worded it sounds like:

They assumed that she couldn't be added before she was physically present in the US so they didn't attempt to add her within the 30 window after their marriage.

Now that she's here they want to add her but his open enrollment isn't until December and they don't have any other "Qualifying Event" to use as the basis for adding her.

There is nothing that can be done to pressure the insurance provider to add her. They have strict policies regarding this and will be in big trouble with the regulators if they don't adhere to them.

no such thing as a temporary citizen and no you will NOT be yet a citizen after 2 yrs. but at three yrs you would be eligible to apply... it is not an automatic thing either

IndigoSkies.....she is not whinning she wants security.....I was in ER in US and my husband put out $2500...this is about health and saving...you shesssssssss!!!!!

On my case we were waited 6 months till the enrollment so with in that 6 months we really dont know what gonna be happend... hope you can make this straight...you will be alright soon.
