My 2 year wedding anniversary is coming up, however, during the last year I have found my wife cheating on me, and talking nonsense about me to everybody. We were very happy before we got married and right after, but then things went wrong. Today we discussed a divorce, however, I am not financially ready to leave the USA yet. I can not afford to leave right now. Is there any way to stay, at least for another 6 months, if I do get a divorce? Is there a way to stay longer? We have not yet removed conditions on my greed card yet, that will only happen in March 2007.

If you can prove you had a bonafide marriage and you entered into it in good faith, then you can file to remove conditions on your own.... do a search on VJ for other who have done this they may be able to give you better advice than me...

Good Luck

HI!

I am very sorry for this happening to you.

Yes ,you can Remove the Conditions by your own and by the way, you dont have to wait to file until your 90 day of the Conditional Card expiration. As far as i know you can file the I-751 earlier then that, after the divorce proceeding is final.

Also your wife theoretically suppose to financially support you under the I-864 Sponsor;s Affidavit of Support until you become a U.S Ctitizen., unless she may cancel the I-864 by writing a cancelation letter to the Immigration Service.

Best wishes. (F)

Sincerely.

She cannot cancel the I-864. The obligation for the I-864 is not terminated after divorce.

wjmay,

You can stay in the USA for as long as you are an LPR. According to what you wrote in your post that is at least another 6 months from now. (And maybe 9-10? your post lacks sufficient information).

A great marriage is not when the "perfect couple" comes together.

It is when an imperfect couple learns to enjoy their differences.
