Embassy requesting more pictures after K1 interview

When people refer to photos as secondary evidence, they are talking about using photos as evidence of the two year meeting requirement. When it comes to evidence of a bonafide relationship, I don't think there really is any sort of classification like "primary" and "secondary". I think all evidence that shows a genuine relationship probably has equal weight.

I agree with everything you say Jim. I usually find your posts well thought out and very interesting and informative.

You are right on about Southeast Asia, Haiti and the evidence of a bona fide relationship. This has turned into an interesting topic and some of the postings are making me think I should arrange for some "other" types of photos. I am planning to go back about a week before the interview so I think adding a few tasteful "intimate" photos might be a good idea.

hi guyes

thanks for your posting we realy find it useful,my interview will be next july ,i have evidence as chat logs in msn, google talk, much emails in yahoo,my husband tikets,he visited me 4 time ,hotel recept but no pic we dont have no pic my husband say it not evidence and he dont like to take pic.what i do to convince him and we are not sure that he will come to visit me again before interview mean we wont have time to take eny pic spechily in his visits we went to défferent place.

thanks for eny support.

Particularly for your Embassy/Consulate which is known as a difficult Consulate to interview at and there is always a suspicion of immigration fraud, you must get photos. As far as convincing your husband to take the photos, simply tell him you expect to be rejected without this very important form of evidence.

I am not actually saying you will be denied the Visa, I am only offering a suggestion to convince him to take pictures together.

I am very sorry but this does not seem natural unless it is a cultural restriction. Try to plan a visit to Morocco and get those photos.

Good luck to you and all the others here with upcoming interviews.

Not to change the topic, but I can understand them asking for pictures, but asking for "intimate" pictures is over the line, no matter what country it is...What rights do they have to ask me these personal question??? It’s an invasion of my privacy!!!

I personally hope I don't run into these issues because I will refuse to show them any just on pure principal and fight them legally.

Anyway, enough with my grass-root fight the power movement…To the OP good luck to you, hope you guys get approved soon!

I'll go one step further than Audy_Rob, and say that without any photos the chances of you being denied are almost certain. Unless your husband is hideously deformed, the consular officer is not likely to accept any excuse for not having photos. One person could easily sit down and type up emails or chat logs, and make them as intimate as they care to make them. However, unless someone is particularly skilled with Photoshop, they aren't going to be able to hack up dozens of genuine looking photos.

Your husband needs to understand that he's not trying to convince his best friend that his relationship with you is genuine. He's trying to convince a consular officer who doesn't personally know either one of you, and whose primary job it is to find a reason to say "no" to your visa application. The consular officers in Casa are particularly good at finding reasons to say "no". If you happen to be one of the very few applicants who are not asked for any photos, then you might manage to skate through and get a visa. However, if they ask for photos (which is highly likely) and you say you don't have any, then you are not going to be leaving the consulate with an approval notice.

If you talk to your husband and he still doesn't believe you, then give him the link to this forum and thread.

"Intimate" photos doesn't mean anything like that, it just means some photos in a more relaxed, natural setting, rather than posing in front of landmarks, etc.

Get some photos of you eating dinner together, and watching the sunset, or playing cards together, or fishing, or folding clothes together -- get the idea?

I agree. They are not looking for 'risque' pictures but more natural, relaxed pictures (restaurant, bar, amusement park, cooking dinner, etc) than posing with friends or in front of landmarks.

The embassy does make people feel very uncomfortable. I just want to be prepared for the worst scenerio in case they don't accept my pictures. I'll just go and have the wedding in Haiti and file for the I130. How long do I have to wait until I can re-flle for an I130 if I don't get approve for the K1? please advise.

Thanks.

Pics ARE important evidence. Don't let others tell you pics are only "secondary" evidence.

Good luck!

:star:

You're mixing contexts. First, "secondary" does not equal "not important". The context in which photos in general are "secondary evidence" is when used as evidence of meeting in person and as such are not sufficient without "primary evidence" to go with them.

In the context of evidence of a bona fide relationship, photos are secondary to the interview and secondary to the evidence of time spent together but they ARE important.

I suspect that in the case of the OP, the interview didn't go well and that the photos provided were not helpful in determining the bona fides of the relationship. People often get confused about the meaning of "bona fide" and concentrate on showing they are legally married, rather than focusing on the "relationship". Similar issues come up in fiancee cases, where to much focus is given to evidence of meeting instead of separating the issue of meeting from the issue of having a bona fide "relationship".

Facts are cheap...knowing how to use them is precious...
Understanding the big picture is priceless. Anonymous

My (now) husband brought about 30 pictures to his interview in PAP. We had them organized by year(we knew each other quite a while before getting engaged and wanted to show an established relationship.) We included pictures of us at different places, pictures of us hugging, our engagement pictures, and pictures of us with some of our friends who were also going through the immigration process. At the interview they looked at the pictures, but did not ask any questions about them. They asked my husband about 10 questions, mostly about how we met, how he knew he loved me, etc. The whole process in Haiti is crazy and I can only imagine that it is worse now after the earthquake. You are almost there...keep looking forward. Keep us posted and good luck!

We're set for 10 years!!

Thank you guys for all your encouraging words. This website really help me in during the days of distress. My fiance went back to the embassy yesterday and they APPROVED his visa. I thank God for our union together. He will be here in two weeks so I'm very excited and have lots of planning to do since our wedding date is set for August 1st. For those of you waiting to be approve don't give up. Just be strong and stay positive and God will do the rest:-)

Again thank you for all your support.
